I GOT SECTION 221 (g) OF INA DENIAL AT INTERVIEW

Timeline

:crying: I received letter section 221(g) from the consulate. I went with my fiance for the interview and when the consulate saw that I was there she asked who I was and then asked what I was there for and I said that I was visiting and to accompany my fiance for the interview and she said then she will do a split interview. She interviewed my fiance and then me and was stressing the fact that we were both still married while.

dating but me and my fiance were separated from our ex-spouses. She stressed the fact that my fiance ex-spouse was american so she she is sending our case back to the USCIS and gave us this letter section 221(g)

I am still at the foreigin country with my fiance and would like to know what I can do to stop the petition from being sent to USCIS while I am still here.

I would like to know what is the next step I do? where do I file for a waiver? what happens when the petition is sent back to the USCIS....pls I only would like good advice as this is a very emotional time in my life right now, I feel so defeated and dont know what to do.

TIME LINE

09/2007 - Gathered all documents for I-129F petition.

11/09/2007 - Sent I-129F

11/21/2007 - Package sent back to me( I forgot to sign one of my G-325A forms) I cried my eyes out but sent it next day delivery back to USCIS.

11/27/2007 - Received NOA1

02/13/2008 - Received NOA2

02/20/2008 - Package left NVC

02/22/2008 - Case uploaded into Ghana consulate data system

04/08/2008 - Packet 3 & 4 sent to fiance

04/16/2008 - Packet 3 & 4 received by fiance

06/24/2008 - Interview date (God blessings on this day)

06/24/2008 - DENIED visa at interview

06/25/2008 - APPROVED visa at 2nd interview with senior consulate

06/27/2008 - Picked up VISA

07/03/2008 - Fiance entered USA at JFK POE & Got EAD Stamp in passport

07/18/2008 - Married

08/07/2008 - Mailed AOS application

I'm very sorry you are going through this. If you look under the link of the portal for I-601, I-212 waivers, there are some posts that give you information about 221(g) If I'm not mistaken it means that the file has to be reviewed for Administrative Processing/Security Checks. From other posts I have read, I know that this could take a very long time. Do a google serach on 221(g) and read exacly what it says, or ask what it means at the consulate. Did they tell you that the visa was denied,and if so why ? The waiver is usually filed at the consalate and it is adjudicated there also because there is an immigration section there.They do not send the paperwork back to the USA.

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE
