visa limits on spouse visa

Timeline

the acting director says part of the delay has to do with visa limits. I though there were no limits if US citizen married non american. would like to know , if I am right then he is giving bad information to justify them not working on our visas

Giving bad info. There are NO limits on spousal visas based on marriage to a US citizen, only ones filed by green-card holders.

USCIS is experiencing delays due to a flood of petitions last summer.

A website you may be interested in that specializes in the US consulate in Guangzhou China is: http://candleforlove.com There you will find extensive information for preparing for visa interview at the consulate when the time comes.

One last note: Expect a 3-4 month delay from the consulate after NVC sends the case to GUZ. Guangzhou is a very busy consulate, they are the only immigrations consulate in a country of 1 billion people, that is 1/4 of the world's population, this is very much different that all the other US consulates around the world.

Timeline

I was told this same thing by a congress representative that handles immigration issues. So I think its the truth. We have been told that spousal visas are unlimited here on VJ and other sites, yet time and time again, the people who work in the sector are telling us otherwise. So maybe it has changed and there is a limit. Just cause a website tells you there isn't means nothing. We all know how much you cant trust some of the stuff posted on there.

There are no limitations for US Citizens. There are for Lawful Permanent Resident .

Having said that, it is a numbers games on when anyone will be approved.

This just proves my point on how the wrong info can be placed on a website. Just because it says that doesnt mean that its true. How many times have people read the updates on the USCIS site and they were completely untrue? All that statement says is there are no NUMERICAL limitations. It doesnt say anything about time limitations. USCIS may approve your case, but then it still has to go thru NVC AND the embassy. Neither one of these jurisdictions say they follow that numerical approval. From all the stories that I've heard from the NVC, and others there seems to be some sort of redtape at times. Maybe its not a numerical hold up but there is a hold up. Maybe they can only release a certain amount of dates per month, but the amount of visas are unlimited? There are obvious limitations.

Congress approved the numerical limitations on visas for LPRs and for other family-based visas for non-spouses and older children (etc). They did not approve a limit on spousal or minor child visas for USCs. So that is the law.

USCIS cannot impose other limitations on USC spouse or child visas.

They may have a throughput problem. They may be mismanaged and have their own agenda. But that isn't the same thing as them imposing other non-approved limitations on visas. And I think we get into dangerous waters to suggest that they are. Reason? This is the very kind of thing that begins another round of misinformation about the USCIS process. And that can harm someone who is undertaking the journey.

well that IS their agenda. Stopping immigration. If they keep someone from trying they succeed without any paperwork.
