Hi guys,

A summary of our case...sent package beginning of January, received NOA1 with case number end of January. No biometrics appointment until I walked with a info pass into a center three days ago . The officer printed on the spot a biometrics appointment letter dated February, 17 with a different case number and a wrong address, where the appointment was initially sent. After biometrics, I could finally access the case on line using the case number on the biometrics letter. It doesn't say anything else beside the fact that they received the application January 26 and is in process. I am very concerned that the case could have been considered abandoned because I did not have my biometrics done in February. Any thoughts?

Hello!

Now that you have the information and can access the account online, you need to call the USCIS on Monday. Do NOT speak with the first customer service people; they only read the same info. we have access to. You need to let them know you need to be transferred to an "agent" or "officer" - these are the people with all the information....be PERSISTENT. Once you have this person on the line, ask as many questions as you can....they really are a wealth of information!!

It does not sound like it is being considered abandoned.....just that you have not taken your next step. I think the same thing has happened to my daughter's K-1 Visa petition....she does not have her info pass appointment until 06/30.

Actually the case numbers on the NOA and biometrics are different - and only the case number on the biometrics notice can be tracked - so everything seems to be 'normal' except for the wrong address. My wife's NOA had a number WAC-072 etc.; and the biometrics had WAC-081 etc. and only the biometrics case # can be tracked and yes, it just says we received your application blah blah blah. Don't worry about it, its all normal; but if you want to, you can try calling them. Good Luck

First, it is normal to have two numbers for the I-751. The number of the NOA extension letter seems to be an internal number only and is not accessible for the call center personnel or by the applicant. The biometrics number is different and is the one by which you can access your case status. Everyone has two different numbers.

The item of concern is the wrong address on the biometrics letter. Did you get your biometrics letter printed out when you went to an InfoPass appointment? It wasn't clear from your message if that is what happened, or if you got a new biometrics appointment from an InfoPass appointment and the ASC printed out your original letter. Have you done the actual biometrics yet?

If your original biometrics was printed out for you at an Infopass appointment, then I am sure you told the Immigration Officer that the address was wrong and you never received the notification. Did the Immigration Officer tell you they were correcting the address information or did they verify that they had the correct address on file? That is the place to start. If this wasn't discussed, you may wish to make an InfoPass appointment to discuss this situation in more detail and to confirm with them the actual status of your application.

Vermont is very very slow. It seems very unlikely that they have considered your case abandoned; it hasn't even been worked on yet but is still waiting in line. People receive their biometrics appointments at varying times - some not until months after they have submitted their applications, and some just a few weeks after. They haven't even begun to start looking at any applications filed in 2008 - they are still working on applications filed in May and June of 2007! The on-line status information that you have is perfectly normal and the same as for all of us who are also waiting for Vermont to get around to processing our 751s too.

If you are nervous about any impact the delayed biometrics have, or if you are concerned that the address they have is still wrong, then do make another Infopass appointment to address those concerns. I wouldn't depend upon the misinformation line:-).

Thank you all for your answers! Yes, I had the biometrics done same day I went for the info pass. The officer there told me first that a biometrics appointment letter was sent to me in February, she did not say anything about the address; when I told her I did not get it, she printed a copy of the original appointmnet letter with the date of February 17 and sent me to another office for the fingerprints and the picture. Only later I realized the address on the appointment letter was wrong, that is when I started calling the customer service to let them know about their error(it's clearly theirs because the NOA1 came ok at the correct address). I was told it will take a couple of days and somebody will call me back. It just crossed my mind, what if they considered the case dropped because I did not appear for the February appointment? What if they sent me something telling me that the case was abandoned, which I did not receive because was sent an a wrong address?

The most frustrating part is that we have called customer service 4 times before and went for two info passes before somebody took any action. For 5 months we have been told to wait and wait...

I can understand your frustration. Because of all of the inherent delays it makes sense to just 'wait', except when there are problems such as you had with the wrong address, then waiting can create problems. It is a lose-lose situation. You basically have two options: Call the call line once again (and you can appreciate why it is unafffectionately known as the "Misinformation line") and really insistithat you need to speak to an Immigration officer, not the person who answers the phone. They are just a call center and only have 'canned' responses, however, they can be really resistant to transferring you to an Immigration Officer who can help. So, if you are not able to speak to an Immigration Officer via the phone, then your other option is to make another InfoPass appointment (I know it is frustrating!) and bring back the appointment letter with the wrong address and make sure they do the actual address verification/correction at that time. Even though you have time to wait on the application before you can expect to receive notification, you don't want to miss an RFE if it is sent to the wrong address, nor do you want the Green Card to go the wrong address. It is highly unlikely that the case has been abandoned. If it had, you would have that notification when you checked your online status, and since your biometrics have been done, you have fulfilled that requirement too. Good luck in getting it sorted out soon.
