Exploring Options - Has anyone gone to US, gotten married

We are exploring our options, since I already have a six month leave of absence from work, is there any reason why we can't get married, file the CR-1, then I can wait until my LOA is over, and then return to Canada to wait out the remaining 6- 8 months? I would not remain in USA over 6 months and would not adjust status whilst in the USA.

Any thoughts or experiences please.

No reason you can't do that, if you can show ties to Canada when you get to the border and if you're asked. The hard part about going for an "extended vacation" is explaining to the POE that you do in fact intend to return to Canada. That said however, I didn't have any problems when I went in 2003, and I didn't even have a job or home ties. I'd just been laid off and I had sub-let my apartment to my Mum. And I was already married. I had a return ticket for 3 months, and told him I'd just been laid off and I needed a break, I was going to spend some time with my hubby.

divorced - April 2010 moved back to Ontario May 2010 and surrendered green card

I would not think it would be a problem at all. You're so lucky you can do this! I'd be sure to bring your LOA papers, or something from your employer about when you're returning to work in case they ask.

Thanks you two, I have all the necessary documentation about my LOA, membership in housing co-op, 176 days of out of country health insurance. So I guess we are all ready :)

Timeline

I married an American citizen in 2002..Traveled back and forth between Canada and the United States till 2007, and upon trying to get back to the United States was refused entry..Immigration process began immediately as we had the I-130 forms already filled out ( just not mailed)..What I have learnt from this nightmare of mine fourteen months and still in a holding pattern regarding paperwork, is that what we should have done is NOT Gotten Married filed as fianace for the K-3 visa (which seems to be a whole lot quicker way to go) You have to Prove your marriage, plus you also have to prove that you maintained residence while in Canada..It took eleven months just for immigration to prove that indeed I did marry a United States citizen, and that he is above the poverty limit. It's been no easy time for either my husband and myself, but our marriage is a strong one and will survive.
