Timeline

My fiance was denied the visa. First they asked she come back with a timeline. She had one already prepared. They would not even look at it. They said it must come from the petitioner and be notarized. So I sent one via global express and she took it to the embassy. They then simply denied her the visa, saying they believe it to be a sham.

They state that my fiance does not know the basic about me such as the name of my parents. My fiance gave them the correct answer. Hell, she write to my mother regularly, how would she address the envelope if she didnt know her name? Not to mention she has had my G325 for a year now.

My fiance told me that she did the interview in vietnamese with a lady translating to a male american consular. I think she didnt translate properly or they were simply dead set on denying her. It makes no sense to ask for a timeline by me and then flat out deny her for stuff unrelated to our timeline.

I sent in another letter today to address the reasons they gave for denial and to plead my case in hopes to reverse the decision before they send it back to the states. But I think we will be screwed this time. :crying:

If I have to go thru this again from square one, you can bet I will be applying for residency in some other country as a backup plan while the US continues its fustercluck of an immigration system.

We've been warned about the Translator's. We were advised not to use them if at all possible.

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

i had to send a notarized time lime alot, they aksed for it to be hand written too. after that we did ok. also she didnt need a translator, the officer could speak VN to her, but my fiancee can speak english. can your fiancee speak english? they probaly thought it was a little weird that she already had a timelime prepard before the interview. did you try calling the consulate? you can call them and ask them for info on it if you have the case number. i got some helpful tips when i called after our first green slip.the lady i talked to told me to make sure i write the letter by hand and to take my time before sending it them. she stressed taking time. oh btw what color slip did she get?

One the petition goes back to the US you are basically screwed! At least we were!

You have to correct it while it's still at the embassy.

Yeah. My lady had a translator also!

K1 denied, K3/K4, CR-1/CR-2, AOS, ROC, Adoption, US citizenship and dual citizenship

Sorry to hear of your trouble American. Contact the person Wideawake was referring to as soon as you can. In my experience, a congressman or senator can not do much other than obtain information about your case or request they meet with you. They do not go to battle for you with the consulate. Atleast mine didn't. You need to that yourself. It would be helpful to know exactly what the blue/green slip states as reasons for denial. I hope you can overcome this. You want to do all you can to keep the case at the consulate.

Yes, the translator told my fiancee, now wife, that for me to take time and write the timeline in hand-writing. We submitted both typing and hand-writing timeline and were notarized. After that we're OK with a Pink slip. The Vietnamese translator was nice. Thank you. (F)

I managed to get thru to the embassy by phone. They would not let me speak to a consular. The person told me all I can do is send a letter explainign each reason for denial but that they would make no promises that it would affect the decision. I wrote a letter to address each reason and added a 4 page personal note. I will spare you the personal notes but here are the reasons they gave and my resonses to them:

Reason 1 – Consular stated that:

“The Beneficiary has contradicted herself and does not know the basic facts of the relationship. The beneficiary first claimed her aunt in the US is familiar with the petitioner but then states she has no relatives in the US. The beneficiary does not know when the petitioner proposed to her.”

The aunt in question is not a blood relative. She is an aunt through marriage and friendship. My fiancé answered accurately that she does not have a relative in the US if she interpreted “relative” to mean a blood relative. Mrs. Lan helped raise Ha when Ha’s parents died, so she is an aunt to her in ever sense of the word, save blood relative. This is a simple error in translation.

As for her not knowing when I proposed, I stated in the timeline document that I did not propose to her on any given day. We came to a mutual agreement that we would marry over a period of time. There was no official proposal until the engagement ceremony where, by tradition, the marriage is arranged by the two families.

Reason 2 – Consular stated that:

“The beneficiary does not know the basic fact regarding the petitioner such as where he was born and the names of his parents.”

My fiancé told me she gave the correct answers and does not understand why the Consular said they were incorrect. First off, Ha has had my G325 Biography form in her possession for about a year now. She knows this information. Secondly, Ha has corresponded with my mother via postal mail. How would she be able to address the envelope and not know her name? This just makes no sense at all! My fiancé explained to me that the interview was in Vietnamese with a translator. I can only assume that there was something lost in the translation. The names of my POB and parents are difficult for some people to pronounce, maybe this is the reason for an incorrect translation? The bottom line is it is impossible for someone to come this far along in the process and not know the basics of the petitioner.

Reason 3 – Consular stated that:

“All of the beneficiary’s emails to the petitioner were written in English however the beneficiary was unable to show any comprehension to the emails she claimed to have written.”

When I first met Ha, she spoke very little English. Since then, she has been taking English lessons regularly. Most of our emails, especially the initial ones, were written with the help of her English teacher who assisted her in translating her words to me from Vietnamese to English. So if you had her one of those initial emails and ask her to read it, she might not be able to. However, if you were to translate it to Vietnamese, she would surely remember writing those thoughts.

I admit that the language barrier has been the biggest obstacle in our relationship and this petition. But Ha has come a long way in her English. But when we were together, we had no problem communicating with each other. I did not even bring a English-Vietnamese dictionary on my trip and we managed fine. Our top priority upon her arrival to the US is to focus on learning English and learning to drive. I plan on teaching English her with the aide of Rosetta Stone Software Levels 1-3 English. I feel that total immersion into an English speaking culture and nightly exercises in the language software will accelerate Ha’s English fluency.

Whether you accept the translated emails as words “from her” or not, the fact remains that she communicated her thought to me, and I to her, in the best possible way we could manage. If she does not remember a particular conversation, that only proves she is human. Who can recall every conversation they had over the course of a year?

Reason 4 – Consular stated that:

“Photo evidence submitted cannot establish the petitioner and beneficiary in each other’s presence for more than approximately four days.”

This statement is true. We have only had one visit together and picture to span this time period. However, according to the requirements on the I-129f application, it states that you must have met your fiancé in person within the past two years. We have fulfilled this requirement. Believe me, I would love to be able to jet set around the globe and visit Ha every few months. But not many people, including myself, can afford multiple trips around the world. We had hoped that this one trip would suffice. And in truth, I have just now earned more vacation time from work I stand ready to come to Vietnam and come to the Embassy in person if this will help our case. So please, if my presence in Vietnam will help in any way, let me know and I will be there as soon as I can obtain a travel visa from the Vietnamese Embassy.
