Custody issue - Medellin CO

Can anyone help with a lawyer recommendation or any other recommendation? I need help with a custody issue in Medellin Colombia.

I should have expected this, but still, it came as a shock and also came on the heels of submitting the I-129F to the USCIS. My fiance's (CM) ex is, to put it nicely, is an evil self-centered drunken sod. I'm not quite sure of the specifics, but the children cannot leave the country without his permission. He won't give it, not because he loves the children, but simply for spite. The children dislike him and want to come to the US. He never sees them. Not that it matters, but he has also threatened CM with physical harm on numerous occasions.

Thanks for any help, glenn

Hello Glenn,

Try going to www.poorbuthappy.com to see if anyone can recommend a family lawyer in Medellín. And you're right the DAS (Departamento Administrativo de Seguridad), which is Colombia's national security agency won't let any child under 18 leave without permission from both parents. This permission slip has to be issued within 30 days before departure, although some people have said that the DAS did not allow them to travel because the permission was issued more than a week.

From what I understand custody battles are very difficult and take a very long time to be processed. While you're in the process of finding a lawyer I would recommend trying to plea with the father or try to find a way to get him to sign so the children can leave after their visas are issued. Also, keep in mind that since the children are Colombian citizens, every time they go to Colombia to visit and want to come back to the States, they will have to have a new permission signed by their father.

Would he sign the papers for money? Maybe a few thousand dallors would convince him to sign?

I was thinking the same thing but wasn't brave enough to ask.
