Timeline

I need to send in my I-864. I have a copy of the 1040's that I sent in for the 2006 and 2005 tax years, but no W2's. Is this going to be ok?

For 2007 I have not files taxes yet (we have an exten. until Oct.) Can I just copy the un-submitted 1040 and copy my W2?

* Jul 16, 2007 - Sent I-130 to Nebraska Service Center

* Jul 19, 2007 - I know it's sitting in the PO Box today

* Jul 27, 2007 - Check cashed for I-130 Fee

* Aug 2, 2007 - NOA1 Arrived in the mail dated Jul. 25

* Sep 19, 2007 - ~Touch~ Placed with I-129F

* Dec 4, 2007 - ~Touch~ Address Change

* Mar 7, 2008 - ~Touch~

* Mar 13, 2008 - NOA2 Mailed - We got an approval!

* Jun 3, 2008 - Entered into NVC System

*Jun 4, 2008 - DS- 3032 emailed

*Currently waiting to send I-864.

* Sep 6, 2007 - Mailed I-129F to California Service Center

* Sep 10, 2007 - I-129F arrived to Laguna Niguel PO Box

Copies of what you sent in won't be sufficient. You will still have to prove these copies is what you actually filed with the IRS and without your W2's for 2005 and 2006, you won't be able to prove that was actually your income for those years. The easiest thing to do is to order your tax transcripts for 2005 and 2006 and submit that. They are FREE and easy to get.

"The transcript can be ordered by completing a Form 4506-T (PDF) or calling (800) 829-1040 and following the prompts in the recorded message. There is no charge for the transcript and you should receive it in 10 business days from the time we receive your request." THis info came from the IRS page here: http://www.irs.gov/faqs/faq1-6.html

For 2007 don't submit, your unfinished return or W2's. In this case I would recommed you submit proof of your extension until October and an explanation, plus a letter from your employer and paycheck stubs from the last 3 to 6 months.

If you decide to submit proof for 2007:

"If the sponsor requested an extension, the sponsor should provide proof of filing for the extension" link

So basically you need to prove that you filed for an extension, not proof from them of the extension.
