Yeah I am sorry your case is taking so long. I think if that happens I'll get some friends and we'll go with picket signs to our congressmen's office and rioted until on FOX's news channel :)

One last question , before the increase in the fees, what was the waiting times for K3 and or CR-1 petitions for a approval???

4-6 months. If you are talking about the fee increase in July of 2007. USCIS had really done a good job of making the K3 of no use at all. The only time saved was at the NVC other than that they were being approved at about the same time. A while back though the K3 was needed, I 130s were a 1-2 year process then the K3 being done in 4-6 months was a big help.

even my lawyer said they won't pursue the I-129F anymore..

"The I-129F was supposed to be faster than the I-130, but in your situation it is obsolete since it has taken just as long as the I-130. Besides, once the I-130 is approved, CIS will deny the I-129F since it is moot. The goal is not for your wife to enter as a K3 but to enter as an immigrant (green card). So, our lawsuit will ask CIS to adjudicate the I-130. Once it is approved, then you may move on to the next step."

They are a good team of lawyers =) They just can't do anything yet because the demand letter needs 30 days to take effect..

"Once we received the above, we will issue the demand letter. The demand letter will instruct CIS to adjudicate your application within 30 days. If no response is received within 30 days, we will prepare to file the mandamus. The government has 60 days from the receiving the lawsuit to file their response. They are entitled to a 30 days extension. Basically it is at least 3-4 months to complete the process. "

My official date starts May 12.. so pretty much until next week I can't do anything.. I have been calling them everyday too (well, not when I was in China).. but called yesterday when I got back and the person from the 1-800 place said all they were is a "call center" and can't do anything.. she wanted to transfer me to "level 2" officer, but I said forget it.. I have talked with them before and they are no help too.. they just said my case is still under "security checks" and that they can't do anything.. I had to argue and yell with them just to defend for myself.. so I have been through almost everything I can do now - sending letters to president, vice president, senators, congressmen, FBI and others.. haha, don't think I didn't try... =) (in lieu of a lawsuit).. that's what will be next

pretty much if nothing happens after 6 months, complain and call them everyday.. bother the hell out of them.. call them more than their mom will.. I even call more than once a day now because I know each person will give a different answer... :angry: so this lawsuit will take about 3-4 months if anyone wants to pursue it.. hopefully something will come through for me.. about the expedite request, you can try for it, but don't keep your hopes up.. I had several service requests and an expedite try for each, but still failed.. =( even with valid reasons of "financial loss" and "USCIS error" (haha, maybe I shouldn't use this one).. but it is their error for taking so long..

Thank you, Paris Heart!! Yes, I did have a good time.. 2 1/2 weeks of just us being together.. that is the best birthday gift for me =) We had a cake and bought balloons (about 30 of them) and just had fun with her mom and little sisters.. it was simple but it means a lot =).. This time I finally got to celebrate something with her for over 3 years time.. =) (L) We never got to celebrate anything, only over the webcam.. Like for Christmas, we both bought the christmas red hats and just put them on and celebrated over the webcam (like many of you).. I always had to go back once every 6 months, but not during any holiday time.. this next time would probably be Thanksgiving or Christmas.. so we can celebrate again for the holidays =)

for ninjarocket (OP), that reason of moving back is no good.. I tried it for my expedite reason and it didn't go through..

I know what you mean gogo with the web camera, I was so happy to do it at the time, but when I signed off, I just went to pieces. We open our gifts on the web camera, and for my birthday, Marc got my brother to get me a birthday cake, and I blew out the candle on the cake with the web camera. Valentines day we had champagne via web camera, its heart breaking.

I look forward to seeing Marc in September, its all I think of, well besides USCIS. Seems like all our holidays and special events are web camera.

We can share our advice and experiences so others can learn from them.. but I see that people are getting approved in less than 60 days now.. :crying: I wish that USCIS would do the applications in order and not skip the "hard" ones like mine.. yes, most of the time I just have presents shipped over there (like See's Candies, Victoria's Secret -- haha, that's our little secret there, and Amazon.com DVDs).. I bought her lots of DVDs (30+ cartoons and things like "Chronicles of Narnia") - she understands about 70%-80% of it just by listening.. so it's not that bad.. to help her learn english.. and I prepared a schedule for her to learn english (she has homework everyday and I use online material too).. speaking, writing, vocabulary, listening.. all that stuff..

www.esl-lab.com (that's one that I use) - she has gone through all this already.. and is learning about grammar now.. she will be studying TOEFL very soon and her score is about 500-550 there.. so it's not that bad.. but of course there is room for improvement.. =)

Why is your application considered "hard"? And which ones are considered easy?

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!

maybe because she is from China :whistle: guess America is still biased towards some countries... where there seems to be a lot of fake marriages.. so they just hold it.. :crying: :crying: but maybe China had a bad impression so America is being hard on them.. but the thing I dont' understand is that they said my case is still under "additional processing security checks".. and I had sent a letter to the president (Mr. Bush) and he forwarded to the Dept of Justice, who forwarded to the FBI.. they sent a letter to my house stating I had no security checks on both of my cases (from their Records Management Division).. so someone is lying.. and the FBI isn't one to lie about things.. so that leaves only one..

Oh yes, the shipping of packages, Marc loves Ritz crackers, I can not find Ritz crackers in Paris, so I ship him about 5 or 6 boxes at a time, with Grape jelly and coffee creamier, ha ha. And I bake cookies for him along with little what nots here from Texas. I see alot of chinese getting approved. Did you make an inquiry with your senator/congressman what is holding up the case? They are suppose to give you answer if congressional unit requests it.

Here is my story. I've lived problem free life, payed my taxes. One day I decided to marry this girl. But to do so would require her to come to US of A, and so it started. My problem free live turned in to free problems from USCIS! Sure things turned to unsure, certain dates turned to aproximation within months. All logical thinking was out the door, as I filed my papers withing famous Vermont Centre!

oh yes, they did.. they just said that "it is still under additional review".. same answer as USCIS.. what is there to review?? Also, if they wanted more info, they should send a RFE.. and they didn't =( so they are just making some excuse just to hold it.. but now that I have a lawyer and doing a lawsuit it should be different.. yes, CandleForLove has a lot of chinese getting approved.. but maybe something was wrong with my case?? I'm not sure.. I sent evidence along with my I-130.. pictures of both parents with us, and her family too at our wedding ceremony...

hmmm.. that's ok if they did.. at least they should ask for it again.. that may be a good excuse they can use.. well, I have made copies of my I-130 / I-129F.. I have 3 backpacks full of stuff to show them if they want to go to court.. I have kept Western Union receipts, hotel receipts, wedding rings, Skype info (about 15-20 months worth) , home phone records (with her home phone number circled in red), and other stuff).. also, created several folders of copies of I-130, I-129F, and supporting documents...
