Hi all,

I need some guidance. Here is the scenario. My husbands K3 case has been received by the consulate and they are in the process of scheduling his interview and sending his packet of info. Today I received the AOS fee from NVC for "Visa classification-CR1". What do I do now? I don't want to delay my husband coming here any further. Do I go the CR1 route? Or, the K3 route? I know that you will spend less money doing the CR1 route, that is not my concern right now. I just want my husband here. HELP!!

Happy and in love!

I think, just disregard the AOS fee you received for CR1.

Consider your options, ask your husband if he desires to take a Job, and wants to apply for a driver's license shortly after arriving to the USA, keep in mind K-3 is NOT work authorized, CR-1 IS.

CR-1/IR-1 is the superior visa, it results in green-card upon entry, is work authorized. K-3 needs to file for EAD and/OR AOS and have EAD or green-card in-order to take a job, get SSN, and apply for a driver's license, EAD takes 90 days or more to get.

You can always keep the CR-1 process running, and interview first for K-3, and then either use the K3 or just wait for CR-1 interview. Keeping the CR-1 moving gives you mor options.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

So, we can do both??? I didn't know we could do that. I thought once you started on the CR-1 path...that was it....

You can follow both paths as long as they are avialable to you. You can even obtain and use both visas. You decide what's best for you. If you thought the process through before filing the I-129F, then I suspect the reasons you did so will motivate you to continue on that path. If not, you have another opportunity to think it through now.

My main concern is just what is going to get my husband here sooner.

I've also seen people pay fees online to NVC...how do you do that?

Then unless you want to waste money or go back for a second interview, just ignore NVC with regard to the I-130. There's no way the I-130 will catch up if the I-129F is already at the Consulate.
