Is CR1/IR-1 easier than K3?

Hello! ( I would really appreciate any advice.)

I've been busy doing a million things, in addition to trying to bring my wife to America, so I didn't read everything closely. It finally dawned on me today that there are actually 2 possible routes for a quick arrival now. All this time I thought the I-130 was going to take years and years, so I didn't even bother worrying about it -not reading up on it after applying. [i have been on the I-130 track but thinking that it was part of the K-3 process.]

Anyway, it seems like the I-130 has turned into the CR-1/IR-1 visa process for us. I still have not gotten the second NOA for the I-129F, which is coming, I guess. Meanwhile, the CR-1/IR-1 visa process has moved along. I guess once they send me the request for the DS-230, everything will be complete and be sent off to the embassy in Ho Chi Minh City, Vietnam.

My question is this: I just paid $400 for the Agent Fee (which seems ridiculous to me because I'm the sponsor), should I now not worry about the K-3?

I'm a bit confused. Let's say that the 2NOA for the I-129F arrives in the next few weeks and everything is sent to Vietnam, should I still do the stuff that they ask with the CR-1/IR-1 visa process? And if I continue with the K-3 process, I'll have to do another financial support packet, including getting another letter from my employer, etc. Which would be the best way to proceed?

By the way, how does one even opt to stop either of the processes? Can't the NVC or the embassy decide?

[b]August 27, 2007[/b]: 1st I-130 packet sent w/incorrect $190 instead of new $355 fee (Mesquite, Texas).
October 6, 2007: 2nd I-130 packet with $355 fee (Mesquite, Texas).
January 10, 2008: NOA1 March 31, 2008: NOA2 (approved & sent to NVC)
April 14, 2008: NVC sent AOS Fee Bill (Affidavit of Support) $70.00 & DS-3032 form
Received.
April 15, 2008: Faxed wife the DS-3032 agent form to be mailed from Vietnam.
May 5, 2008: NVC sent request for Affidavit of Support form. May 19. 2008: received NVC's request for Affidavit of Support form.
May 20, 2008: Sent off I-864, Affidavit of Support May 30, 2008: Received IV Fee bill for $400 --money order & sent by Priority Mail.
June 10, 2008: I-864 approved. June 11, 2008: IV fee entered in system. June 16, 2008: DS-230 barcode issued
June 30, 2008: DS-230 mailed by expressed mail July 3, 2008: DS-230 package arrived at NVC & under review
July 11, 2008: Case completed at NVC.
Sept. 5th, 2008: INTERVIEW DATE at HCMC: White paper with writing.
March 26, 2009: Resubmit.
[b]DENIED. June 2009: case sent back & received at USCIS[/b]
August 2009: filed new I-130. Approved after first I-130 case sent to VN, again.
February 2010: USCIS contacted & asked for more evidence
March 2010: USCIS re-approved original case.
April 14, 2010: Consulate sends DS-230
June 15, 2010: Interview Date (Blue issued)
July 13, 2010 Placed on AP -yippee!
Sept. 13, 2010 Consulate home visit
[b]Nov. 5, 2010 Approval letter sent.[/b]
[b]Nov. 19, 2010 Visa picked up. Arrival: Nov. 24, 2010[/b]

Timeline

If you are at the NVC now and going through the steps there, then just keep going. I wouldn´t hold your breath about the 129. Ours is still "pending" as well and we´re just about done with the NVC.

I don´t think you ever really want to "stop" your process. I think that will really mess things up. Once you start, just letting things flow may be the fastest way to the end.

05/13/2008 AOS bill invoiced (paid online)

05/14/2008 AOS bill PAID and cover sheet printed

05/16/2008 AOS package sent to NVC (FedEx from Peru)

05/19/2008 AOS package received by NVC (9:30 AM)

05/20/2008 DS-3032 Choice of Agent accepted (confirmation by e-mail)

05/20/2008 AOS entered into NVC system

05/21/2008 NVC recording says I have info missing (false RFE confirmed by NVC operator!)

05/24/2008 IV bill invoiced (paid online)--bad timing-Memorial Day weekend!

05/28/2008 IV bill PAID and cover sheet printed

05/28/2008 DS-230 sent to NVC (FedEx from Peru)--received DS3032 via snail mail!

05/30/2008 DS-230 received by NVC (9:40 AM)

06/02/2008 DS-230 entered into NVC system

06/06/2008 case complete at NVC!

06/12/2008 sent to embassy in Lima, Peru!

06/16/2008 papers arrived at Embassy

06/18/2008 received interview packet (in US)

07/02/2008 medical exam

07/11/2008 Interview in Lima, Peru!

08/20/2008 POE Atlanta, then fly to Seattle

09/05/2008 Received Welcome Letter

10/20/2008 1st wedding anniversary!

Yes CR-1 and IR-1 is easier than K-3 for a few reasons.

  • K-3 requires the filing of an I-129F, CR-1 does not.
  • K-3 requires adjusting status in the USA in-order to get green-card, CR-1 does not.

CR-1/IR-1 is the superior visa, it results in green-card upon entry, is work authorized. K-3 needs to file for EAD and/OR AOS and have EAD or green-card in-order to take a job, get SSN, and apply for a driver's license, EAD takes 90 days or more to get.

Compare timelines, for most CR-1 does not take much longer than K-3 to get.

I see... I guess you still haven't got your 2NOA for the I-129F. I was just gaging everyone's timeline and thought that mine should be coming soon. Thanks!

Also, your $400 was not an "agent" fee. That actually does not exist. the $400 was your wife's immigrant visa fee. Its the fee for your visa. The K1 and K3 actually have a visa fee too but its like $131 cause its a non-immigrant visa fee.

Also, your $400 was not an "agent" fee. That actually does not exist. the $400 was your wife's immigrant visa fee. Its the fee for your visa. The K1 and K3 actually have a visa fee too but its like $131 cause its a non-immigrant visa fee.

Yep, you can forget about the K-3, If you paid that amount to NVC, then you are on the CR-1/IR-1 visa path.
