Ok so about five years ago my 'boyfriend' was deported back to Jamaica ...these are his charges...

SEX BATT/NO SER INJU FELONY WH ADJ-PROB SP COND

2 SEX BATT/NO SER INJU FELONY WH ADJ-PROB SP COND

3 SEX BATT/NO SER INJU FELONY WH ADJ-PROB SP COND

4 SEX BATT/NO SER INJU FELONY WH ADJ-PROB SP COND

5 FALSE IMPRISONMENT FELONY WH ADJ-PROB SP COND....when it happened he was 17 then originally he was suppose to serve one year and a day in the county jail but something happened i don't really know because i wasn't at the last hearing where they told his mother he could get probation or deportation, I'm not really sure,regardless of what happened he was deported an given a five year ban....that was 7 years ago...my question is what's the best option for him to come back k1 visa/k3 or just give up hope of him ever coming back because of the conviction? Is there a chance that he could ever come back?

I hate to say it; but I am going to say no. Jamaica is pretty tough to get through if you have a perfect record.

You can try. It's not going to be easy at all.

I would suggest a qualified immigration lawyer on this one.

No matter which visa you apply for (K-1, K-3, CR-1) you may have to deal with or prove that the crimes happened before age 18.

If the crimes happened before age 18 they may waive them.

(2) Criminal and related grounds.-

(i) In general.-Except as provided in clause (ii), any alien convicted of, or who admits having committed, or who admits committing acts which constitute the essential elements of-

(I) a crime involving moral turpitude (other than a purely political offense or an attempt or conspiracy to commit such a crime),

(ii) Exception.-Clause (i)(I) shall not apply to an alien who committed only one crime if-

(I) the crime was committed when the alien was under 18 years of age, and the crime was committed (and the alien released from any confinement to a prison or correctional institution imposed for the crime) more than 5 years before the date of application for a visa or other documentation and the date of application for admission to the United States, or

Even if his under 18 charges were expunged, would his deportation?

I hate to be the bearer of bad news, but I've had friends with lesser charges that were not able to get through. Sorry babes.

Yessssss and the deportation thing is not good. I would see what the lawyer said before proceeding. For example, my friend's little brother had a few robbery charges while he was here on a vistor's visa he was 17 at the time. He was deported, because he kept getting in trouble with the law. About 6 years later he was granted another visitor's visa. When he got to Baltimore they stopped him and he was arrested and deported again. His people spent so much time and money trying to get him straight. I don't know how he was able to get another visitor's visa since he had charges in Jamaica also.

Ok I recently received NOA2 and was reading some of the post for the process for the Jamaican Embassy and read a post that said I would have to send DS-230 before we can get a interview date and wanted to know if that is correct, and can you please just tell me the process from here on out because I was under the impression that they would send us a interview date with all the forms/info that we need to bring to the interview.
