I-130 and I-120F approved the same day

Hi everyone,

My husbands I-130 and I-129F were approved the same day for K3. I have received both I-797C's for them from USCIS, and I have received a letter from NVC for the I-129F. I am so confused now because I thought they put both petitions into "one file". The letter from NVC states that the I-129F will be forwarded to the "visa-issuing" post overseas. Ok, that's great, but why isn't both petitions going to the Consulate? I have tried to get information from travel.state.gov and read many things within the NVC. Now I just need clarification from someone who has been through the process. Does the NVC keep the I-130 and do some processing/fee collection and the consulate contact my husband for an interview? Someone, please help me understand what will happen now.

The will keep the I-130 on file for when you file for AOS. Once the embassy gets your I-129F petition, they will see that it's for a K3 visa.

Removing Conditions

07/06/09 - I-751 sent to CSC

08/14/09 - Biometrics

09/27/09 - Approved

10/01/09 - Received 10 year green card

U.S. Citizenship

03/30/11 - N-400 sent via Priority Mail w/ delivery confirmation

05/12/11 - Biometrics

07/20/11 - Interview - passed

07/20/11 - Oath ceremony - same day as interview

Congratulations first of all... !!!

Your husband's I 129 f will be transfered to the local consulate where your husband lives in order to issue him a K3 visa. K3 is a non immigrant visa and thus when he arrives in the US you will have to apply for AOS (Adjustment of Status) from non immigrant status to a permanent resident. That is why NVC holds your I 130 petition as they will start working on it when you file AOS.

2oth Aug 2007 - Got married in SL

12th Sept 2007 - sent I 130 to CSC

5th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 247 days )

18th May 2008 - Touch (Guess its been sent to USCIS mail room)

20th May 2008 - Received Hard Copy NOA2

I 129 F

7th Jan 2008 - Sent I 129 F to CSC

10th Jan 2008 - Received by CSC

18th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 130 days )

18th May 2008 - Touch (Guess its been sent to USCIS mail room)

20th May 2008 - Received Hard Copy NOA2

21st May 2008 - Received Docs at NVC

xxx xxx xxxx - Case # generated

28th May 2008 - Sent to USEM Colombo

29th May 2008 - USEM Colombo confirmed receipt

Unless I'm mistaken, hasn't CSC - in some of the recent cases - sent both approved files to NVC (instead of holding back I-130 if I-129F was approved also, contrary to the instructions USCIS sent out end of 2006 (see a link pushbrk posted to this document in another thread)?).

I'm thinking of SPSguy, where this has happened, if I remember correctly.

If both of them get sent to NVC, I assume you can still choose which path to follows.
