Hi all,

As my both petitions are approved i'm now in the process of gathering required docs for the upcoming interview.

I have a question about I 134. Affidavit of support.

My husband was working part time till last year as he was an engineering student. Also some of his earnings were "allowances" and thus non taxable his tax transcripts till year 2007 are not above the poverty line.

But now as he doing his intern he is earning well above the poverty line.

My question is, for my K3 interview will I 134 , a letter from his present employer and recent pay stubs be sufficient ?

Will i have problems reg past tax transcripts as they are below poverty line?

Will we have to have joint sponsors? (his parent)

2oth Aug 2007 - Got married in SL

12th Sept 2007 - sent I 130 to CSC

5th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 247 days )

18th May 2008 - Touch (Guess its been sent to USCIS mail room)

20th May 2008 - Received Hard Copy NOA2

I 129 F

7th Jan 2008 - Sent I 129 F to CSC

10th Jan 2008 - Received by CSC

18th Jan 2008 - Received NOA 1

16th May 2008 - Approved (NOA2 in 130 days )

18th May 2008 - Touch (Guess its been sent to USCIS mail room)

20th May 2008 - Received Hard Copy NOA2

21st May 2008 - Received Docs at NVC

xxx xxx xxxx - Case # generated

28th May 2008 - Sent to USEM Colombo

29th May 2008 - USEM Colombo confirmed receipt

you can submit the tax returns and you can provide the past six months of paystubs and a letter from the employer stating the amount per hour your husband makes, plus the annual salary. That way you can prove that although he made less than the minimum last year, this year he will surpass the requirement. I don't think sendng the past tax returns will hinder you, they just want to see that there is steady income and that your husband will be able to support you. It is up to your husband on if he wants to obtain a joint sponser.

08-14-2008- Approved!!! 216 days...

08-21-2008- NOA2 Hardcopy received

08-27-2008- NVC Receives file, NVC Case Number issued

09-05-2008- AOS Fee Bill and DS-3032 Generated

09-06-2008- E-mailed DS-3032 to NVC

09-11-2008- Received Hardcopy of DS-3032 and AOS Fee Bill

09-15-2008- Mailed Hardcopy of DS-3032

09-16-2008- Paid $70 AOS fee online

09-17-2008- Received E-mail confirming the DS-3032 Agent

09-17-2008- Printed Coversheet for AOS paperwork

09-17-2008- IV Bill Invoiced

12-16-2008- Sent I-864 EZ to NVC

I have the same exact problem, but with I-864 form. I have barely worked in the past three years because of school and started working full-time this year. So my tax returns will show that i'm not above poverty level, but pay stubs and employee letter for this year will show that I am. Do you think I need to have a co-sponsor?
