Hi friends. I am new to this. I am in the process of filling out form I129F, to bring my fiance Dao to the states so we can be married. I have had a rather difficult road, financially in the past, ie:this includes a bankruptcy which has been paid and has been recently discharged. I earn approximately $36,000 per year. Things are getting better now...I am wondering what the USCIS is looking for as far as financially...I am kind of nervous about this, as my history is not the best. Please if you can help with any experience & comments. I would greatly appreciate it. Thanks.

USCIS does not look at any finances in the I-129F stage. That will be left to the US Consulate in your fiance(e)'s home country prior to visa issuance.... Typically if you can demonstrate that your income is at or above the 125% of poverty level then you should be OK....

Thanks fwaguy, Does that mean they will be looking at my fiances,,, finances in her country, or mine...I understand that in some countries they look for the person being sponsored to have some kind of legitimate reason for going back. Such as proof of land , home or business ownership...Is this what you are refering to or will they specifically look at my finances?

Thanks again...I will be sending in the I129F in approximately 3 weeks...Dao & I will keep our fingers crossed, and hope for good results. Thanks again...

They don't even look at your foreign fiances income or finances. You mentioned you heard that they look at proof of land, home or business ownership, or in a nutshell, ties to their country. That isn't for a K-1 Visa, that's for a tourist visa.

Why would they want to see this for a K-1 if the beneficiary is intending to immigrate to the US legally for marriage purposes?

You mentioned you filed for bankruptcy? I tried to search for what I found about this, but couldn't find it. Basically, I think I heard that if you have filed for bankruptcy, that you need to get a co-sponsor, although I am not 100% sure if this is correct. Hopefully someone else can help out with this.

Other than that, the foreign beneficiary's finances and income has no weight whatsoever on the K-1 Process.

They look at income and do not do a credit check, so there is no way for them to know about a prior bankruptcy.

I am also interested in this question. My fiannces will be good this year, above the limit. But last few years I was not above limit. I did have some savings money then tho, can I show that as explanation of why I didn't work too much then? Thanks

They care about what you are making right now. If you are 125% or above the poverty line for your household there is usually no need to show any other source of income. Each consulate has it's own criteria for the affidavit of support so check with others here regarding your particular consulate.

Yes, I thought that also, however I noticed on one of the forms - I think its the I-134 - that you take with you to the interview, it asks you to show tax record of only the last year but then still asks you to write in how much you made on tax returns for the 3 past years. Does it hurt you if for the last year you are above the limit but write the truth that you were below it on the other 2 years? Anyone have this come up at their interview?

:thumbs: Thank you all so much for all the info...I am sure that I am fine as far as income. Do you think including copies of my most recent paystubs with the application would help? Also maybe a copy of my last w1040, for this last year...That will show how much my earnings were this past year. I am planning on sending the K1 visa app. out this Friday. Thanks, again. You don't send any proof of income with the petition. ;) It comes later with the affidavit of support (I134) when your fiance attends his/her interview.

It's after your approval you can start collecting paystubs and financial documents. ;)
