ADVICE AFTER I129F HAS BEEN APPROVED

Hello anybody who can help,

My husband and I are still in the process to get my K-3 Visa to the US approved. We've got our NOA of approval of the I129F on 2008-04-15. My husband is currently visiting me in South Africa, but right before he came here he enquired from the NVC about when we can expect to collect our "packet 3" from my local Consulate in South Africa. He was adviced that the NVC will send him a letter on certain steps than needs to be taken by him, and pay a fee of $70-00 before they continue processing our case.

Can anybody advice me what this is about. I was under the impression that the next step will be the transfer of our Case from the USCIS to the NVC and then straight to my consulate for the medical and then interview.

Any advice will be appreciated.

YEA, THEY ARE RIGHT I PAY THE SAME AMOUNT THEY CALLED IT HIDDEN FEES, SO IS BETTER YOU PAY FOR THAT MONEY SO THAT NVC WILL BE ABLE TO PROCESS YOUR PAPER TO THE CONSULAR IN SOUTH AFRICA, U CAN GET BACK TO ME IF YOU NEED ANYTHING M ORE

there are no hidden fees

that means that USCIS sent both I-130 and I-129F to NVC instead of just the I-129F

If you want a K3 visa, ignore the request of payment of ths extra fee, as it is a CR1 fee.

NVC will foward the I-129F petition to the consulate and proceed the K3 visa

Timeline estimated adjudication on April 4, 2008. It was adjudicated on April 23.

Our I-129f was approved in 197 days.

08/may/2008 - replied to my e-mail sent on april 30, saying that our petition has been sent to the consulate.

Consulate

20/JUN/2008 - Interview - APPROVED!!!

AOS

18/mar/2009 - Packet delivered

24/mar/2009 - NOA for AOS and EAD date

25/mar/2009 - Check cashed

15/apr/2009 - Biometrics done

22/may/2009 - EAD approved

Well, definitely the $70 fee would be in connection with the I-130, not the I-129F but we don't have information that two petitions went to NVC. The petitioner would need to call NVC about both petitions to see if they have only the I-130 (quite possible if adjudicated in Vermont) or both petitions. If they actually do have both petitions then the OP does have the choice of whether to pursue the CR1 in and K3 or just the K3.

Confirm both petitions are there. Don't assume.

Just to get more understanding. If both petitions are there at NVC and if the petetioner wishes to go with CR1/IR1, would the application stay at NVC for a longer time than K-3? In other words, if NVC has both of these petetions, would election of CR1/IR1 cause the beneficiary to come to the US late than if K-3 had been chosen?

The aleged advantage of K3 is that it is faster.

NVC took 4 days to send my K3 petition to the consulate.

According to the timelines here it takes NCV 168 days to send the CR1 petition to the consulate. So there is deffinitely a time difference on the NVC fase.

There might also be a difference at the consulate.
