I would almost want to demand a hearing before an immigration judge rather than file to re-open a case and pay for it when it is their error! Geeze - this is definitely a case where I would get my Senator involved and get lots of publicity. If you have to repay, it is clearly a money grab and nothing else. An Immigration hearing means that they have to bear the expense and it will almost certainly go in your favour since you were denied for something that never happened - a failure to show up for biometrics - and you have proof from them that you did show up. I sure hope someone with common sense in California looks at this nonsense and you get your approval very, very soon.

I missed this thread, which shows what can go wrong here at VJ. InfoPass, calling CSC or senators -- puh-leeze.

The petition was DENIED. That is a legal action with legal consequences, and none of you are qualified to advise the OP on how to proceed from here.

The OP needs an attorney. I know you're all trying to be helpful, but it's like moving someone with a spine injury -- you could cause even more harm by being what you think is helpful. Sometimes it's best just to tell someone they should lawyer up, not pretend you know the answer.

To zypher: whether you actually can resolve this more or less informally with CSC and then perhaps appeal the denial via a motion to reopen on form I-290B or whether you should or can wait until you are called up before an ILJ for deportation is something I would discuss with a lawyer.
