Urgent: USCIS Error.. PLEASE PLEASE PLEASE HELP!

Hello everyone,

I have been in the I-751 processing since Feb 2007 (NSC transferred to CSC) and I just now received a letter from the USCIS saying that my application has been denied because I did not show up for the finger printing and biometrics. BUT I DID. I have a receipt, right in front of me with their stamp and signature on it. What should I do?

The letter I have received says that I will soon receive a notice to appear in front of the IJ. Please help.

Was your case ever 'touched' online after you did your biometrics? Usually, when they take your fingerprints your online status is 'touched' a day or two after your appointment. First, you should call them immediately and let them know. Then, schedule an infopass appointment > http://infopass.uscis.gov/ and bring all of the relevant documents. I believe that you will be fine. I assume that person that did your fingerprints did not *finalize* them as he/she suppose to. Try to stay calm, you did everything you suppose to do, so there is nothing to be afraid of. Mistakes do happen and we’re talking about USCIS here.

I didn't know what 'touched' meant until very recently. So, no I didn't check the 'touched' status after my fingerprinting was done. What is really making me paranoid is that the letter says that I cannot appeal to reopen the case since it has been considered abandoned. It says I will soon received a letter to appear in front of an IJ. I am so paranoid.

I am in the same situation. I got letter from USCIS, California Service Center yesterday. and another letter from USCIS saying that they received my biometrics and fingerprinting. I am so surprised. Today I made info pass and went to local office, the officer also got surprised, he told me that he is writing email and will call me when he gets response from USCIS, Service Center. I also made couple of calls to 1800 number but everyone gives different opinion. One said it is an error of USCIS, California Service Center. It is an error. I also sent certified mail to Director of USCIS, California Service center providing my affidavit( the receipt of my fingerprinting and biometrics and confirmation letter from USCIS). Let see how does it. I hope it should work because it is not my fault. It is USCIS error.

Please update your situations as we are in the same boat. lets fight with these people.

Packet 3 sent in July 22nd.

Packet 4 received July 29th.

Interview scheduled for Sept. 14th.

VISA approved Sept. 14th!!

Marraige on November 18

it is actually very sad to see that you too are in the same situation as I am. I cannot believe that they play with our lives like this. It is very difficult to deal with this emotional stress. Anyways, I too will be sending a letter to CSC Director, first thing tomorrow morning. Let me know as soon as you hear anything from the officer at the local office or via any other correspondence. Thanks for your posting. Yes these people play alot and make alot of errors we are not exceptional, the officer at local office also realized and admited it . I am also under alot of stress because of this unfair decision but we shouldnt let it go easily as we havent done anything wrong, its their fault . The funy thing is the case status online still shows that my case is pending and received as It was updated on may 15,2008 but my denial letter is dated May 5, 2008, another funy thing is I have got a letter from USCIS dated May 9, saying that they received my biometrics and my case is processing, How come same USCIS sent 2 different letter in two different issues, it is very controversy. Anyways, Did you call them and ask whats going on with your case? Or what does your case status online say? Does it say denied or pending? hope things will work out if not we should do something. Please keep in touch. I will post my outcomes and hope to hear from you also.

In the worst case - you would go in front of the Immigration Judge (as it says in your letter) and show him that you indeed did the biometrics as scheduled - could you then ask him to immediately issue an order for a greencard? :D

At a hearing before the IJ, the alien would present the evidence that he or she complied with USCIS requirements. If the IJ sees that this is the case, USCIS would be have an opportunity to refute that claim. The important issue to remember when called before the IJ is that the onus lies with USCIS to prove that their decision to deny was correct. In the event that the IJ disagrees, he would order that USCIS reverse their decision.

Hey Zypher,

Another funny thing about my case. I got another letter( dated May 9) today from the California Service Center saying that they are actively processing my case from the same office that wrote a denial letter on May 5,2008. Which letter do I believe? Anyways, keep on posting whats going on with your case.
