Well guys, we got our AP documents on friday. We planned a trip to vancouver canada on saturday. So we drove there, crossed the land border into canada with nexus as we all have nexus so no questions asked. On the way back to the US, we crossed with Nexus as well into the states, the border guard asked my wife and sons status, we told him they are AOS and have AP, we showed him the AP and he let us threw. He didnt stamp it or send us in to stamp it. My question is, is this considered abandoning the AOS because we did not properly use the AP, but it wasnt our fault, and we dont want to stop so why would i hassle the guy to stop us and get it stamped. also, is there anything i must do with the AP document when entering canada, do they have to sign it. And if i go through nexus again, and no one asks anything do we still need to present the AP, or only if its asked for?

I'm pretty sure it doesn't matter if they stamp it. I've read many others who have gone through and not had it stamped. I don't think you abandoned anything.

I'm not sure how Nexus works or anything though.

A couple of things:

Showing the AP to Canadian authorities when entering Canada isn't necessary.

You need to present your AP regardless of if you are asked or not when re-entering the US, and they are technically supposed to stamp the AP paperwork to confirm you have been "re-paroled" back into the US. I also had to fill out a white I-94 form and that was stamped as well. Perhaps Neiks or Zyggy will see this and answer your questions more crrectly. :)

so what would happen if we went through the border and didnt show them our AP and were admitted. because we were admitted isnt that better than being paroled???

Just to let you know...

You can't use NEXUS to go into the US when you're on AP... You have to wait until you get your GC to be able to use it again. Be sure to go to the NEXUS processing center where you got the card to have your Permanent Resident status added to your NEXUS file. However, as far as I know, you can use NEXUS to enter Canada.

Right now, take it that you got a freebie... but next time you enter the US and every time until you get your GC, you must use a regular lane.

I am a former CBP officer. You entered the NEXUS program with the intention of entering the US as a visitor and you stated as such when you applied. That situation no longer applies, therefore, you are not permitted to use NEXUS. It is also not available to parolees due to that nature of that status. It is not up to them... it is up to you to follow the rules of the program. If you are caught not following the rules, the privilege of using NEXUS is taken away for good.

There is no publically available documentation on this matter. However, an I-512 Advanced Parole document must be used at a normal Primary Lane and must be entered into the system and processed at Secondary to be activated, just like a visa. Each entry you make on AP after it has been activated must be entered into the system at primary. Again, you got away with it this time... don't continue to test your luck..

well i wasnt testing my luck, i didnt know, and now i do. and like i said, we crossed through nexus not knowing, i did show and tell the CBP office the AP document, and he just said to go on through. i did not know it cannot be used at nexus. now that i know. i will not go through nexus. thanks for the info.

To answer your original question, JS..... no it's not considered abandoning the AOS. The same thing happened to me, once. I was back and forth quite a number of times using my AP. During one crossing, the officer neglected to send me thru to secondary..... just waved me through. It didn't affect the AOS process whatsoever.
