Hi everyone :) does anybody know how I get my K3 visa if K1 was prevously issued ? Me and my fiance are going to marry in US and come back to Germany, where we currently live. Does Ambassy transfer K1 into K3 or we have to start whole the process again? I am going to change my passport also, since I change my surname after getting married -does it affect the case somehow?

I appreciate any help....

N-400 timeline (under sec. 319 b from overseas)

9/13/2010 - N-400 packet sent to Vermont

9/21/2010 - NOA

3/11/2011-after emailing Faifax Office: biometrics scheduled for 1 Apr, 2011 and interview date 6 Apr 2011

4/6/2011 - interview and oath ceremony

You would have to start the whole process again. Would it not be easier to just adjust status in the US from the K-1 after you marry?

It's not clear from the limited information you provide what visa might be appropriate for you subsequent to your marriage and return to Germany. In any case it will be a new visa.

When you return to Germany, how long to you plan to stay there? And if you didn't plan to stay in the USA after the marriage why did you apply for a K1 visa?

Another question.. if the USC has residency in Germany, why don't you apply for an Immigrant Visa in Frankfurt by DCF..

We are going to us only for a few days to get married in Las vegas and we won't have time to do any paper work.We have to come back to Germany, because my fiance is in Air Force stationing here.

I need a K1 visa to get married in US. I talked to people in the US embassy and they told me that. I am not sure how long we stay here. we may be living in 6 months or 2 years...I don;t know yet...

I'd like to apply for a green card in Germany, but I am affraid it will take so long, f.e.15 months. We may be living Germany in 6 months(I don't know yet) and I think I should apply for a new visa as soon as I come back from US (on K1 I can enter US only once).

The proper visa for what you plan to do is the B2 visa, not the K1 visa.

Later on, when your (then) husband gets re-assigned state-side, apply for an immigrant visa.

As Yodrak said, you do not need a K-1 visa to come to the US, get married and leave.

K-1 is for moving to the US to stay.
