Expedite Denied

I'm just beginning to get my head around it now, and thought I'd post about an expedite denial.

My Husband sadly lost his Grandmother a couple of weeks ago, which happens as we all know, but she was more like his mother.

I loved her dearly, but obviously didn't attend the funeral due to being stuck in England waiting for this laborious process to end (not enough documented ties to risk POE).

This being hard enough to deal with, his Aunt who is also very close has now been diagnosed with terminal cancer and has a couple of months to live.

Obviously, we tried to expedite .... internally via the USCIS Military Helpline .... we didn't think it was possible, but the USCIS officer who dealt with us personally put together the request immediately and said it shouldn't be an issue and that we'd hear within 5 working days .... well, we did ..... VSC said no.

Neither his Grandmother or Aunt saw us get married as we married unexpectedly on the fly at Christmas when I was over there (it was the right time for us) ..... but we had planned to renew our vows and have a big party when I return .... I guess this won't be happening now.

I'm quite blown away, and understand that it's obviously because the latest bereavement and the next one that will happen in a couple of months are not my Husbands parents .... but I still think it stinks that they can belittle the requests of a family in need and pain like this.

And to think, we were originally planning to get married this summer with all the family following a possible application for a K1 .... but had no idea as to the difference in time for approval ..... if we'd done it that way, I'd more than likely be there by now :clock:

Just want you guys to know, incase something similar happens.

Plus, if anyone from USCIS happens to read these posts, please have a heart (and read up on karma) ..... there are a lot of people suffering on this website ..... if they weren't, they wouldn't be on here in the beginning.

Thankyou Loto, I appreciate your wishes ..... this is why I've been quiet lately. I didn't really know what to do for a while, and I thought verbalising it may help.

I'm just hoping now that my Husband's Grandmother may be able to prove life after death and move some paperwork ... we just need that NOA2 .... NVC onwards should flow fast and hopefully I can be there for the next funeral .... better still, be there to help my family go through something really hard.

my heart goes out to you and can understand how frustrating it must be sitting miles away and not being their with your loved one during these testing times (F) . if USCIS had any insight into human suffering, i guess none of us would have to wait. The US Government needs to do overhaul this process and department. I get pissed off every time I hear that a H-1 visa holder is able to call their spouses in matter of a few weeks and yet lawful citizens like us have to wait for months and years before our cases are approved.

Not that I am on the side of the various immigration offices in any way, shape, or form; but I can see their caution and points. Too many people before us have abused the system. While some of it is just bureaucratic paperwork, some of it is genuine need to be cautious for reasons that have bitten them in the butt in the past.

I am sorry it happened to you in this case.

You are both so right .... the worst part of this is, I used to have a greencard 12 years ago .... but it was deleted due to not understanding the system back then. I never expected to fall in love with an American years later, so I wasn't bothered.

It wouldn't take them 5 minutes to reinstate my A# and SSN.

The fact that there are so many of us on this website in the beginning, pouring our souls out to complete strangers should prove just how much USCIS doesn't care about family. I've read so many heartbreaking stories since being on here ..... if karma and reincarnation exist, most of USCIS will probably come back as .... well, it wouldn't be nice to say.

Yes, the frustration is quite awful .... I can't begin to describe it .... oh, that's right, I don't have to, you ALL understand ... that's what makes this so bad, we're ALL hurting.

Ah, yes, the H-1B's .... but let's not forget that migrant workers come under Human Rights .... don't ask me how or why, but if you google for USA Human Rights, migrant workers are right there ..... our spouses are not.

I'm so appreciative to everyone who's taken a moment to console anothers pain ... when everyone of you has your own pain to deal with during this long and drawn out process. Thankyou.

Thankyou, and yes, I'm actually in total agreement with you with understanding their caution, and I agree that a lot of their points make sense

I know that to USCIS I'm just another set of bland old paperwork and photographs .... but I'm pushing 40 years old .... I'm really not into the whole notion of greener grass ... plus, I used to be a US resident before, if I was that desperate for a greencard, I wouldn't have let my last one lapse .... stupid me .... I guess USCIS don't really see that side to it.

Maybe USCIS could look at implementing a different system of checks? .... I mean, they don't really bother about the old guys who flock to foriegn countries for young girls who they allow in on the superfast K1, do they?

I'd be quite happy to go to the immigration office with tons of evidence every 6 months if I have to .... the love bug bit me good .... I'll do whatever it takes to be with him.

However, that also includes looking after my new family .... right now, I'd jump through hoops of fire.

I am sorry to hear sarah...tough news though .........Any have we are all on sameboat (BROKEN USCIS BOAT) ...Only god knows when we get to our destination ......I wish you good luck in this process .I guess we need to develop

KipandSarahJayne: My heart goes out to you. I know exactly how you feel. I also thought it was just a formality after breaking down on the phone to a very kind USCIS expedite officer. If you have the time, it certainly would not hurt for you to contact your congressman and senators. There has to be a human element somewhere in this process.

I wish you both the best of strength and blessings. This road is so difficult. Thank God that you have each other.

Just trying to muster the energy (and the money) to do this again.
