appealing on k1 pending case

Timeline

my fiance got her interview last yr in month of april in india n after that she was asked to submit joint sponcers papers with her case coz my incomes was bit low n as she submitted those her passport was returned with a letter stating that her case has to undergo administrative procedure n till now we have no answer frm embassy its been an year now n now they say ur case is been sent to usa for further review n rest all cleared frm here(india)plz anyone can help me

n now v r plannin to appeal but v dont knw that if we can appeal coz ourb case is not cleared n even denied

have you had your state rep check into it to find out exactly what is happening? if the case has been sent back it could be expired and gone, if for some kind of further checks i know some take long time. First you need to know exactly where it is and your rep can do this. Have you done any kind of check before now in the months earlier?

my fiance called up indian embassy,infact she calls every week n they say ur case is cleared frm india n is sent to usa to get security clearence n once it done they will contact n issue visa n its been a year we r hearin same answer same time,n i too call nvc to check status but they say ur case pendin n not cleared yet so v plannin to appeal while its status is pending,coz some of our friends say it may be put over somewhere n the staff forget about it but if this really happen thn how we remind thm about the case coz only way is callin them n that we do regularly

You are probably in the dreaded security checks. Call DOS at 202-663-1225 push 1 then 0 to get a real person. Give them the case number and they can tell you if it is "undergoing administrative processing". If it is there is nothing you can do. Contacting your representative or senator might help but it is unlikely. I have been in the same situation since April 2007 also. It must simply go until all the checks are completed.

Actually, this is one area where an attorney would be able to help. You'd basically need to file a lawsuit in federal court, asking it to order the Govt to make a decision in your case. The Court wouldn't do anything; but usually, the US Attys who defend the case will get the FBI to finish the "name check" and then your case can proceed. If you really are caught up in the record check problem, there really isn't any other solution at this point - though they just announced some grand plan to clear the background check delay by the end of the summer... ugh.
