Filing I-129F delayed processing of I-130 in my case!

Hello Friends,

I am pleased to announce that I got approval emails for both I-130 and I-129F. Thank you for your support and my sincere best wishes to those still waiting for approvals from USCIS. I shall post here the relevant contents of the approval notices once I receive them. At this time I don't know if both I-130 and I-129F were transferred to NVC.

On April 4th, I spoke with an immigration officer from California service center. She initially told me that my I-130 filing date was showing as January 2008 and so I'll have to wait for a few more months before my filing gets to an immigration officer. When I explained that my I-797C notice of action actually shows a receipt date of September 25, 2007 she took my phone number and said she would call me this week as she needed time to research my case,.

This officer was kind enough to call me this morning and told me that since I filed I-129F in January, my I-130 was also showing as filed in January 2008! She told me she would corrected this mistake and my case should get processed soon.

So August / September 2007 I-130 filers if you are still waiting on NOA2 for I-130 and also filed I-129F, it is possible that your I-130 got paired with I-129F. This could explain why October / November I-130 filers are getting NOA2 ahead of us.

5-07-08- AOS FEE now says PAID online, can print cover sht.

5-07-08*cald NVC and msg says AOS $recvd

5-12-08-DS3032 EMAIL Accepted

5-13-08*cald NVC and msg now says DS3032 choice of agent has been received.

5-13-08-mailed AOS i864 packet w/printed cover sheet from online payment (certified mail- priority)

5-15-08-AOS packet received by NVC

5-18-08 iv FEE bill invoiced

5-18-08 iv fee $400 paid online

5-20-08-iv fee cleared, able to print covr shet online

5-21-08-mailed DS230 packet to NVC via priority mail

5-29-08 aos ACCEPTED

5-29-08- DS 230 entered in system

6-3-08-cse cmplte.

6-11-08 case left NVC to chennai via DHL

6-16-08 case reached chennai

7-2-08 appt letter received by beneficiary

7-4-08 medical done in chennai

7-28-08 interview- AP for 4-6 weeks (awaiting name chk clearance-told by chenai operator)

8-20-08 chennai forwarded file to DOS- according to inquiry from congressmans office

(also confirmed by DOS)

8-28-08 file reached DOS- told by operator

9-2-08- last update to case,told by DOS

12-12-08 emailed chennai embassy asking status of our case, and got email to send passport..

12-15-08 submitted passport to vfs

12-19-08 VISA ISSUED! in hand!

12-25-08 hubbys arrival! smooth POE!

1-16-09 green card arrives

1-27-09 SSN card in mail

I called CSC, I spoke to a guy on the phone, I explained everything like you did, that the receipt date on the NOA1 is Sept. 4th 2007. I told him I was waiting for 7 months. This guy had nothing to say but "just wait, both your I-130 and I-129F were put together and are being reviewed." He said that it is with the Adjucator. He seemed not interested that I was waiting for 7 months and that I am a September Filer. He said that he can't tell me when it will be approved, "maybe today, tomorrow, or 2 weeks." Those were his words. What should I do, I was thinking of calling at another time during the day, today, so I can talk to someone else?

In my case the case was not even assigned to an adjudicator. Based on what the officer told you, it appears your case is being worked on. I think you should wait for another week before calling again.

I actually did call again at 2:30pm yesterday before your reply. I talked to a lady this time, who put me on hold to see where my case was, she was very polite. She told me the same thing but in a more optimistic view point than the other guy. She said that both my I-130 and I-129f have been put together and are being reviewed, aswell as the expedite processing I requested in February. She told me to give it a few days than check online for my status. Sounds good:)

I think some glitch in USCIS case management system made I-130 filing date to match that of I-129F. I know there are quite of a few of us in this situation. I trust my conversation with the immigration officer corrected my I-130 filing.

Corrected or not, both petitions are likely to be approved the same day. Then your I-130 will be held anyway, making all dates associated with it moot anyway.

Here is an update: When I called NVC on April 23rd, I was told that NVC received and entered I-129F on April 22nd. They also sent all paperwork to the consulate in India. When I inquired about I-130, NVC operator told me that I-130 has been recevied from USCIS but has not yet been entered into the system. Yesterday, when I called the automated line, I got the NVC case # for my I-130 (2weeks of transit time from USCIS to NVC!).

K3 filers, as in my case, it is possible for both K3 and I-130 to be worked on by NVC.
