Timeline

Hi everyone...I'm just trying to get a clearer understanding of this process, as this is the one that I plan to do w/ my husband. Now, please bear with me as I have a couple of questions!

1. Once the petition for the I-130 is approved, it then moves forward to the NVC? Right?

2. Once it's at the NVC, I know there's a ton of other paperwork to collect, but are there any other approvals necessary, or is the case simply complete when all of the forms and fees have been collected?

3. Once the case is completed at the NVC, do THEY assign an interview date? If so, is it a date that they pick, or is it a date given to them by the Embassy of your spouses country?

Those are my main questions at this point...I probably will have tons more, but I'm just trying to sort the whole process out. And does it seem like there's a 5 month waiting period between the filing of the petition and case completion at NVC?

Once USCIS approves your petition it will be forwarded to the NVC. Once the NVC starts processing your case you will be sending documents in as they request them. You will also be paying a visa processing fee ($300 something). Once the NVC completes your case they will set an interview date and forward it to the embassy. I'm sure once interview date has been set it can be changed by contacting the embassy.

NVC will forward your case to Embassy in your spouse's country. Since every country has different requirements, embassy will have different Interview process.

02/19/2008 : NOA1

02/20/2008 : $355 check cashed

02/25/2008 : Case available to view online

09/04/2008 : Email: Case arrived and pending at CSC

Not happening...that's why I'm asking about the CR-1 process

Once the I-130 is approved, USCIS will send the file to NVC. You will need to submit choice of agent, affidavit of support fee and packet, IV fee and all other documents that NVC will ask from you. NVC is scheduling for interviews for applicants' from many countries. While at NVC, you need to pay $70.00 as Affidavit of Support fee and $400.00 as Immigrant Visa fee.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Hey Tamisha,

Yes this is hard to wrap your head around. I was on VJ 10 months before I applied for my CR1, but I gathered so much knowledge in that time and read so many posts it was easy once I was actually applying. To answer your questions:

1. Yes, USCIS will inform you its been approved (or not) and then forward it to NVC. You will now be done with USCIS.

2. Yes, essentially since you were approved by USCIS, NVC is just collecting and processing forms and fees. Your case is complete when they are done. Familiarize yourself with James Shortcuts Even if you choose not to use them, they give a relly good detailed view of the NVC process.

3. This question is answered differently per country. For JA, Kingston Embassy is an "Appointment Post" meaning that they receive all appoinments for immigrant visas via the NVC. NVC randomly generates your appointment...you cannot choose it. Its been happening on average of 6-8 weeks after NVC completion.

I would average 5months from your USCIS approval notice to interview....about 3 months in NVC and 2 months to interview.

I know your story and why you are now filing CR-1. Have you officially cancelled the K-1?
