Changing from K3 to IR after petitions are approved

Timeline

Any idea how to do this? NVC won't give me answers cause they do not have my case yet. USCIS says I have to call Mexico and ask the consultate which will they choose for me. Anybody know what to do? I emailed CDJ twice and they say they no longer return emails. I tried to call the 656 number and it is just automated.

* Jan 3, 2003 - Met the love of my life

* Oct 18, 2006 - We got Married

I-130:

* Jul 16, 2007 - Sent I-130 to Nebraska Service Center

* Jul 19, 2007 - I know it's sitting in the PO Box today

* Jul 27, 2007 - Check cashed for I-130 Fee

* Aug 2, 2007 - NOA1 Arrived in the mail dated Jul. 25

* Sep 19, 2007 - ~Touch~ Placed with I-129F

* Dec 4, 2007 - ~Touch~ Address Change

* Mar 7, 2008 - ~Touch~

* Mar 13, 2008 - NOA2 Mailed - We got an approval!

* Jun 3, 2008 - Entered into NVC System

*Jun 4, 2008 - DS- 3032 emailed

*Currently waiting to send I-864.

I-129F:

* Sep 6, 2007 - Mailed I-129F to California Service Center

* Sep 10, 2007 - I-129F arrived to Laguna Niguel PO Box

* Sep 17, 2007 - NOA1 Arrived in the mail dated Sep. 12

* Sep 19, 2007 - ~Touch~ Placed with I-130

* Dec 4, 2007 - ~Touch~ Address Change

* Mar 7, 2008 - ~Touch~

* Mar 13, 2008 - NOA2 Mailed - We got an approval!

* Apr 7, 2008 - Entered into NVC System

* Apr 9, 2008 - Sent to CDJ Mexico

* Jul 7, 2008 - K3 Interview Scheduled. Not going!

Are you sure you want to do this? CDJ takes over 9 months longer to process CR1 than a K3 visa

Yes I am sure. They have sped up the process a lot and with the time I will have to spend still working on it in the US I am happier to wait now. I am positive I want IR, but I can't seem to get it done. I keep getting the run around.

You can stall the K3 at the NVC and continue with the IR1 with the NVC. It hasn't even gotten to CDJ yet.

First the I-130 would have to be forwarded to NVC. That is not the current USCIS policy. Unless he gets lucky and they forward it anyway, he'll have to file the I-824 and associated fee and wait an indefinite period for USCIS to send the I-130 to NVC.

If you want an immigrant visa, don't file an I-129F.

You have to request in writing to USCIS to forward your I-130 petition to NVC if they don't. Some people get lucky and both are sent but most likely only the I-129 is going to be sent; however, you never know with USCIS. You have to do it in writing and follow up because they are going to lag. Once it's at NVC, just continue with the I-130. The I-129 will move quickly through NVC but you can stall it by not following up on it.

Per Laurel Scott, a lawyer that advises the Juarez forum and I2US members, you used to be able to request it at the consulate but they no longer do that. It has to be with USCIS.

The interviews for CR-1 are not taking 9 moths anymore. They are taking from 2-3 months since NVC started scheduling the appointments after the case is complete.

Pushbrk - I called USCIS cause I asked this before and you told me about the I-824. She told me that they no longer had my application and that I was not to fill out the I-824. She told me to call Mexico. I don't understand that because my NOA2's say that both petitions were sent to NVC yet they were not both received. I guess I will wait out the six weeks (which is what they keep saying is the amount of time it takes for the I-130 to get the NVC) and go from there.
