My american boyfriend worked on a tourist visa

My american boyfriend and I met in my country, and in a company where I worked for. He was my trainer for the job I got in. At first we were just casual, but after a couple of months we started dating. The owner and managers of the company did not know. He went back to U.S. last november and now he is going to petition a Fiance visa for me.

The conflict is, he went to my country with a Tourist Visa, not a working visa. Since we will have to describe how we met in the petition papers we will surely bring up that he worked here in my country while having a tourist visa. He wasn't compensated enough though. He was just paid for the living expenses, and his airline tickets. I think he just got $500 a month, yet it was okay since he wanted the experience. He stayed in my country for 8 months, and paid the overstay. (He lost his passport within that period though, so he had to stay longer)

But anyway, my question is, would the USCIS or the US Embassy care about his visa? Would they still approve the petition but face some other legal consequences? I think this has have to do with IRS or about this form, where they asked for previous employments. G-325A, Biographic Information Applicant.

Because if there will be a conflict, I guess we have to lie about how we met.

Or not get married at all which I dont want to happen.

This is not a problem, the do not care about a US Citizen working in a foreign country on tourist visa.

USCIS is concerned with foreign citizens working in the USA on visas that don't allow work.

OUR TIME LINE Please do a timeline it helps us all, thanks.

Is now a US Citizen immigration completed Jan 12, 2012.

I agree, they only care about your relationship and your status, meaning that you didn't come to the US ilegally in the past. The whole process is 90%-95% all about you, the beneficiary.

I would strongly urge you not to lie. My understanding is that if the USCIS discovers you have knowingly lied on your application (and giving the wrong information about how you met is definitely "knowlingly") they can decide to permanently deny you a visa to the US.

Best of luck!

Well, if you can assure me that they will not take it against between the two of us. I think we will really not lie. I am not going through with it, if I have to lie. I already thought about the situation, and it sucks. I was just worried about his visa. But I asked him last night and said there would be nothing wrong if he had to tell about his work in the Philippines. I don't know why, but he is smart enough to know that, so I guess I will just have to trust him.
