Will my package be sent back??

Hi all.

I posted about this before (not including the G-325a because it was not in the I-130 package on uscis). My mistake for not getting the forms off vj, instead of the "official", -never updated- USCIS website.

Anyway, my petition (I-130) was received at Chicago Lockbox Dec.11,2007 and then received at VSC Jan.31, 2008.

I have a NOA1 that says received dec.11, 2007.

My check was cashed feb.2,2008 and received hardcopy NOA1 Feb.5, 2008.

Does anyone think my package may get sent back and I must start completely over and pay another fee or will I get an RFE? I am seeing my case online as pending since it was entered on feb.24, 2008.

I'm looking for personal experiences of others and general, educated guesses on this.

Trying to see if I should preempt with sending info or waiting for a RFE (risking possible outright denial -horrors upon horrors.

If they were going to reject your package I do not think they would have cashed your check and issued you a NOA1. For the cases I have seen returned , they will send your package back with a letter stating why they sent it back. In those cases the check is not cashed and no NOA1 is issued.

I think they may send you an RFE for missing info.

And the VJ guides clearly state to include 2 original G-325(a) per person on the application.

My advice is to stop asking this question and start gathering the forms and other documentation you may have omitted and prepare for an RFE.

Edit: I noticed I typo'd and you submit 4 original G-325(a) with your I-130.

It is best to wait until they send you a RFE, as it is a hundred percent sure that they will. When they do you will hear it on the automated system if you call.Best of luck!

Yes, I remembered answering it. Why post the same question twice? Just prepare your G-325A sets. Please read the I-130 instructions carefully. It clearly says one needs to submit G-325A (one set for petitioner and another set for forein alien spouse) when applying for spouse.

if someone doesn't know something, I would think they have a right to ASK.

If no one doesn't feel like answering, that is another story.
