Medical expedite rejection

Timeline

My fiance married 2 non-Americans a few years ago. He applied for a medical expedite a few weeks ago because his grandmother got cancer but USCIS rejected his expedite. Is it because the medical expedite is for his grandmother? Or it's because he married 2 foreigners, USCIS needs more time to investigate his background? Other reasons? Thanks for help :star:

Why would they expedite because a family member is sick? The family member is not immigrating.

USCIS only expedites for a very few reasons, such as petitioner is in military, and has orders to be deployed overseas, medical expedite has to do with the petitioner being sick.

Is now a US Citizen immigration completed Jan 12, 2012.

He has the divorce certificates from his two previous marriages correct? I'm hoping you sent in copies of those with your petition. :thumbs:

They won't expedite for a family member.

Yes, I sent the divorce papers with the petition. I also explained that my grandmother who is dying of cancer raised me and acted as my parent. The next step is having my congresswomen write a letter.

To be fair there are others on here that have been expedited due to family members and health. It took much longer for USCIS to make a decision (about 60 days) and they had to involve their congressman. It probably came down to the strength and tact of their plea, IE. for cultural reasons it is very important that the mother in law meet the spouse, the mother in law has 6 months to live etc. etc.

Though expedites for the past year or so have been very rare. Basically for the past year USCIS isn't respecting its own rules. (Not that your situation necessarily fits exactly inside their criteria i'm afraid anyway)

Yes. In fact there was someone here on VJ who recently received an expedite from USCIS, but I'm pretty sure they had a congressman involved also. Note that if he does somehow finagle an expedite that he will need to request an expedite at every step. NVC will not honor a USCIS expedite, and DoS won't honor an NVC expedite. He'll have to file them separately.

The 2 factors I see that might have influenced USCIS's decision are 1) his grandmother might not be closely related "enough" to fit their guidelines. I.e., if it was his mother or father they might have made an exception. This is a guess on my part, don't take it for gospel. 2) Either the nature of her cancer isn't considered severe enough, or your fiance didn't provide enough details about the nature of the ailment.

I sent a very sincere letter along with a doctors prognosis. It's criminal that this government can do this.

The criteria is, to my knowledge, a case-by-case judgment. Either your grandmother's illness was not deemed "life threatening" enough, or you didn't make a compelling case to the adjudicator. I don't know the specifics of your case, so I can only guess. If you believe USCIS adjudicated your expedite incorrectly, you should probably start looking at other options such as involving your congressman and/or an attorney.

Your fiancee's timeline indicates you filed in December at the Vermont Service Center. Vermont has been getting cases out in about 3 months, so I think an expedite at this point is moot anyway. Your case will probably be adjudicated very soon now.

Michael, for whatever it's worth, these things are rarely granted. I know you're mad and it is personal, but don't take it that way.

Your best bet would be to seek the assistance of an elected official.

When and where was your petition filed?
