Getting Married in the USA to USC ...

Hi Everyone,

We applied for a K-1 visa on october 1st and still no word. Now, we plan to get married on Oct 11th in Oregon but if the visa is too late or denied we plan to go ahead with the wedding and then come back to the UK and possibly do DCF later - if getting rejected for our K-1 doesn't scupper that plan.

Obviously I can't enter the USA on the visa waiver programme as we are planning to get wed so what do we need in the way of entry visa in order to get married to my US fiance and then leave?

I know about all the evidence of my plan to leave again but do I need to file for something else and, if so, how long will it take to get the stamp?

It looks like your approval is right around the corner. What makes you think you might be denied?

Once you are approved you will have 6 months to use the K1 for entry and then 90 days within which you must marry in the US. So, October shouldn't be a problem if you wait to enter the US until July or August.

You can 'usually' enter the US while awaiting your visa. You can even enter to marry...as long as you leave again. Many people have. But, you need to have lots of info that will tie you to the UK and prove you are going home. It's the intent to immigrate that the POE officer will be looking at.

If, for whatever reason, your K1 is denied and you choose DCF your USC fiance will need to reside in the UK with you on a legal visa for 6 months (most countries are now 6 months..might wanna check that ) before you can start the DCF process. This is as of last year.

Remember..... the K1 is a one time only entry so once you're both here in the U.S. you can't leave unless/until you get AP.

Hey now i think ur approval is coming fast i saw someone get theirs not too long ago that was filed in july noa1 in aug.........just hang in there u will be here way before oct..............

I agree with Ronan, Sara it has been a very long wait for you. And Ronan stay positive!!!! I am sure you will have visa on time for the wedding. Well we do have similar timelines and I am supposed to get married on 08.08.08 in Las Vegas .......so imagine how I feel

You will most likely have your visa before your planned wedding. As of yesterday, CSC had approved about half of the October filers, so your NOA2 should be coming soon. The rest of the process moves more quickly (although processing times at the consulate vary from consulate to consulate). If for some reason you do not have the visa, though, starting over with DCF will mean just that---starting over. What some couples have done is had a wedding ceremony and party without getting legally married. I would suggest that may be a better option if you are delayed. But I really don't think it will be an issue--you are still within the predicted time frame for an October filer.

Estadia, I know there are still a few July and August petitions getting their NOA2s now, but you are outside of USCIS's official time by about a week, so you should be able to get them to check on your petition now (or do you have to be past their time frame by a month?). If that does not work, then you should contact your congressman as others have suggested.

True--on both of those.

I think you'll have your NOA2 soon. They seem to be about half way through the October petitions, if VJ timelines are a representative sample, and they are moving faster than they were a few months ago. Once you get it, things will move a lot faster.
