Filling I-751 but spouse and I live in different state

Hi all,

Just wondering if anyone has this situation before. I got my conditional gc about a year back and would be due to file the I-751 end of the year (2008). My concerned now is that I started a job 3 months ago in another state after 1 long year of unemployment. I got the impression from reading the forum that you have to live together to show the marriage is real. Our marriage is real and the reason why I accepted a job is to build financial security to achieve building a family in the long run... ie. house, kids... retirement. We see each other once a month, I'll drive home during long weekends or he will come visit. We will be filing tax jointly but apartment leases, utitlities bills and all is in our own name.. his apartment and mine.. we do talk on the phone everyday and I think phone statements will be one of our proofs too... still... not living together and not having mountains of proofs concerns me a ltitle too much.

I would appreicate if anyone that went through this kind of situation gives me some feedback. Right now I am clueless..

it's not a requirement. There are many people that have to live separately for professional reasons. Just make sure you mount up enough of the other sorts of evidence.

I think you should be fine. You stated very clearly why you do not live together, I think that could be included in a letter or discussed at your interview (if you have one). Even though your leases are not joint I'm sure you have (or could get) a joint credit card, savings account, health insurance. You could always add your spouses to your spouse's bills, its just a matter of calling the company and adding it.

Correct, this is not a major problem for removal of conditions, but later if you do decide to naturalize for US Citizenship, this can cause a problem.

I was in college out of state while dating and later married to my ex-spouse while going through AOS. The officer asked for any proof that I attended school out of state such as transcripts and housing agreement that I was bound to, etc. Your spouse should gather those at minimum. 

ROC timeline:

09/17/18 Mailed packet

09/19/18 Delivered (signed by D Hernandez)

09/24/18 Check cashed, Text/Email both received with receipt#

09/28/18 Receipt# started working on USCIS Case Status Online

10/20/18 Received biometrics appointment letter

10/22/18 Received NOA1

10/24/18 Early biometrics walk-in completed

10/25/18 Fingerprint review completed

Hello friends.

I am separated from my husband and the only proof of the relationship we have is the bank's statements, and photos together.
I still do not divorce. I'm afraid to start a divorce myself. Would that be advisable or could it further harm my process?

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
