Technically you can use any name you like really - as long as it is your legal name and obviously this is.

Your visa will be produced in the name that appears on your passport.

Your best bet would be to discover today, whether you can change the name in or get a new passport in your current legal name. Obviously, this was something to have been done months ago.

You can use any name you want. However, when your husband petitioned for you, what name did he use? If he used your current married name, you should have changed your passport accordingly. If he used your name using your late husband, you don't have to worry about anything.

I-130 Timeline with USCIS:

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Well when he filed the I-130 he used Mrs. Doe not the current im using now..the problem is i've already had the medical using my passport with my late husband name on it..they accepted it..so meaning can i get another passport using his name? i can do that as long as there will be no problem to what i started...am I right? anyways, thank you for the response.. :star:

You can ask the passport office whether they can change the name into your current name. I don't think, you will need a new passport. But only the passport office can tell you for sure.

I checked on DFA regarding the passport, here's what they say: For married women who chose to adopt surname of husband

* Marriage Contract (MC) in Security Paper issued by the National Statistics Office (NSO) or CTC issued by the Local Civil Registrar duly authenticated by NSO.

For fiancees and spouses of foreign nationals

* Original and photocopy of Commission on Filipinos Overseas (CFO) Guidance and Counseling Certificate of Attendance.

I think i can change my passport to my current husband name but the question is...if this will affect my medical? coz i'm done with my medical using my current passport..what do you think? :(

i have different last names on alot of things, it hasn't yet caused any complications.

It may not cause any problem at all. But it is better to keep everything same.
