Timeline

I am just so bored and so frustrated and so ... __________ (reader's choice to enter a negative emotion).

I was reading up on K-3s and thinking of forgoing the IR-1 for a K-3 (cost isn't really the issue here) but now I see even more evidence coming in that K-3s are no longer an option.

I think I need to blog some more, at least that is cathartic.

I will take all the help I can get. I made an appointment for an immigration attorney consult. I want to run the get divorced/refile as K-1 idea past him. If anything, its free entertainment since the consult is free.

I also ran the idea past my senator's aide. He acknowledged that it is a legitimate idea and a problem with the system as a whole that K-1s are processed so quickly and K-3/CR-1 are not. He said he has seen this argument around for awhile now and it has still not been addressed. With the K-3's in haitus, I am just wandering around randomly looking for relief.

How long you reckon until the I-130 goes through and you get the interview?

So you were saying, in another thread, avg time between NOA1 and 2 is now 92 days, takes about 4 months to get through NVC, then 2 months to interview give or take. So around 9 months?

The 2 months to interview will fly by, but even focusing on the 7 months doesn't seem like a helpful option.

Ours took 11 months.

My personal estimate is at 18 months (beginning Feb 2008 which is when USCIS acknowledges receipt of our I-130). I think this is a 'if everything is perfect' scenario. Much of it will depend on how NVC will be able to handle the large amount of increased applications that hit USCIS a few months back. I see that USCIS has staffed up for that increase, but don't see anything coming out of NVC saying the same which is worrisome.

So you were saying, in another thread, avg time between NOA1 and 2 is now 92 days, takes about 4 months to get through NVC, then 2 months to interview give or take. So around 9 months?

The 2 months to interview will fly by, but even focusing on the 7 months doesn't seem like a helpful option.

Ours took 11 months.

Its now at 92 days, but they are just working on Jul and August 2007 filers. I think that average is going to be creeping up considerably over the next couple of months. Consider that these people didn't get their NOA-1s until December 2007 and January 2008.

Ok, so I was just thinking. Let's pretend that receipting was never a problem at USCIS and they issued NOA-1s within 2 weeks of receipt. In that scenario, with them just now issuing NOA-2 for July and August filers, they are taking 6-7 months to approve the I-130. Per my converstation with my senator's aide last week, NVC processes I-130s in about 3 months, so with a little added bulk from the increase in petitions, lets just say it takes them now between 3-5 months to approve the I-130. Add in 4-6 months for Montreal (assuming the flood of applications will be spread out around the world's consulates and individual consulates won't feel the deluge).

I guess my original estimate of 18 months is not so far out after all.

But doesn't your appointment get scheduled by NVC and not MTL? I am confused.

You are right. But, that would probably just increase the projected time line as NVC gets busier and busier. Thanks for that pick-me-up. :P

May 7,2007-USCIS received I-129f
July 24,2007-NOA1 was received
April 21,2008-K-1 visa denied.
June 3,2008-waiver filed at US Consalate in Panama
The interview went well,they told him it will take another 6 months for them to adjudicate the waiver
March 3,2009-US Consulate claims they have no record of our December visit,nor Manuel's interview
March 27,2009-Manuel returned to the consulate for another interrogation(because they forgot about December's interview),and they were really rude !
April 3,2009-US Counsalate asks for more court documents that no longer exist !
June 1,2009-Manuel and I go back to the US consalate AGAIN to give them a letter from the court in Colon along with documents I already gave them last year.I was surprised to see they had two thick files for his case !


June 15,2010-They called Manuel in to take his fingerprints again,still no decision on his case!
June 22,2010-WAIVER APPROVED at 5:00pm
July 19,2010-VISA IN MANUELITO'S HAND at 3:15pm!
July 25,2010-Manuelito arrives at 9:35pm at Logan Intn'l Airport,Boston,MA
August 5,2010-FINALLY MARRIED!!!!!!!!!!!!
August 23,2010-Filed for AOS at the International Institute of RI $1400!
December 23,2010-Work authorization received.
January 12,2011-RFE
