I-864 updates at inteview

Timeline

I completed and sent NVC my I-864 at the very end of 2007. Since it was still 2007 I provided tax returns from 2004, 2005 and 2006. It was approved with no problems by the NVC.

Now it looks like my case will be complete sometime this month with a interview probably in May.

So will my wife be required to show my tax returns from 2007 since the interview will be after the April 15 tax deadline?

Or it won't matter since the NVC already approved the AOS and forwarded it to the embassy.

I only ask because I wanted to file for an extension on my taxes and file joint with my wife after she gets here in May and has an SS#.

She will have a copy of my extension form, 2007 W-2s and recent pay stubs to show just in case.

Not yet, I'll be doing it tomorrow.

I'll see what they say, but just to be on the safe side I might just file now as married filling separately to have a tax return to show at interview. Then when my wife gets here do an amended return as filling jointly. Twice the work but I don't want any unexpected surprises.

Well, I called and was told that if my interview is after April 15th then I will be required to show 1040 and W-2 for 2007. I asked if only the W-2 would be acceptable and was put on hold and later told "no, they also want to see a complete 1040". It doesn't matter that my I-864 was already approved by NVC.

So now I have two options:

1. File married filling jointly, get an ITIN number for my wife (and all the hassle that involves) and loose my stimulus check this May.

2. File married filling separately and then file an amended joint return when my wife has a SSN.

Filing for extension would be perfect in this situation, too bad they want to see the tax return at the embassy.
