Current Status - K-3 and I-130 - my 2cents

but short-term there may actually be better NVC service if they no longer have to handle K-3s and many "optimists" refuse to start the CR-1 process in hopes of still getting their K-3.

Misinformation: better service at the NVC if they no longer have to handle the K3's

You ask the NVC if they can provide better service if they process all CR1's instead of K3's.

Then report back to the readers who need some real information. Not just hearsay.

Where is my miinsformation? Use some logic...people continue to file for th K-3 petition. It takes longer to get to the NVC if you file K-3 rather than CR-1. Therefore, petitions take longer to reach NVC . So...at the moment Cr-

There is nothing false in what I stated. So before you start putting specific "labels" on people please read and be clear first.

I'm afraid I'm having difficulty following your statements. In a discussion, it's best to give an alternative view and why rather than to simply say somthing is wrong. It is particularly confusing when more than one statement is made.

So we're all clear, why don't you state your own view as to how flip flopping the mix of CR1 to K3 cases at NVC will impact timelines and workload. Maybe we actually agree.

Facts are cheap...knowing how to use them is precious...

I think Lurking is confusing your comments to me as comments directed at her. Given her zeal for arguments and fussing, I'm not surprised. But she ought to pay better attention to the flow of the conversation.

BTW, you have, alas, convinced me to see it your way regards NVC.

I am not arguing. My goal here is to gather accurate information for people who have concerns and misconceptions of what is going on. There is a lot of confusion that needs to be cleared up right now. I really would like someone to demand in writing the result of their I129F petition. Once this is in writing, then we can move forward. What they are doing is illegal and against the laws established around the process to protect the USC and the USCIS.

I state facts that I discover through reading the USCIS, employee manuals, laws & regulations, and petitions directions!

Then I state my opinion through interpretation of the above facts, VJ time-lines, and forum topics and discussions. But do not through out general terms that will confuse people reading to discover information regarding the process. Save that information in the "off topic" forum.

I try to make it clear whether it is a fact or a surmise of my understanding and the source.

Your statement was inaccurate and you did not state why you thought that people where not processing their CR1, which I have not found anyone that was doing this. Not even I, who wants to go the K3, has stopped the processing of my CR1. You also stated that the service at NVC would be better. Better then what? I have not heard any complaints yet, around the NVC processing times and policy.

"I" "think" that this quick turn of events of approving I130's and supposedly "administratively" closing I129F petitions will create a back log at the NVC. I have come to this conclusion through "my" understanding of the NVC process through what I have read here on VISAJourney.

So not only is there going to be an noted increase in petitions, but also an increase in types of petitions.

He quoted what I said to you. That is why I assumed that he was stating I was in denial. I am not in denial about anything. OK maybe a few things, that have nothing to do with the visajourney. *wink

Your misinterpretation of my zeal and fussing is toward the USCIS not toward VISA Journey members. We need to provide accurate information so that members can make decisions that will expedite their visa and protect their rights as US citizens.

Before I found this site I had no idea what was going with the process and had fear around the process. Now that I have read the USCIS's website and found this website I am no longer fearful of this process.

You can make choices based around the information provided from the users of this site if it is accurate, because the users are the most informed. If you are ready for the battle, you can make choices around the laws and your rights.

I just do not want people making vague statements that will cause more confusion to people who are confused enough.

This whole debate is somewhat humorous. It reminds me of the debate that was going on during the August-December 2007 when USCIS was reporting no forward movement on processing I-130s at all on their receipting report. I stated at that time, as many other did, that USCIS was not processing I-130s at all in favor of other application types (e.g. naturalization) and many people rebutted "USCIS has not come out with a statement advising they are not processing I-130s at all so therefor it is not happening!"

The results are evidence in and of themselves. There were no NOA-1s issued for I-130s from either CSC or VSC during that time frame and only when USCIS announced that they were sending the I-130s to Chicago in December for input did the NOA-1s start coming out. It is clear from this example that USCIS does not announce their every move. Only after their announcement about the Chicago Lockbox processing did everyone believe that USCIS was doing nothing but stacking up the I-130s in their mail rooms and ignoring them prior to that date.

USCIS processes can be judged more accurately by what they are actually doing then what they announce (or don't announce) they are doing.

It's not a similar situation at all. This time people are not just not receiving any word or action from USCIS. They are having their petitions closed, and they are not being told why.

24/mar/2009 - NOA for AOS and EAD date

25/mar/2009 - Check cashed

15/apr/2009 - Biometrics done

08/22/2008: Received RFE for Affadivit of Support and Medical

10/21/2008: Submitted I-865W in lieu of co-sponsor and medical info to NSC

11/14/2008: online case status not updated since filing of AOS in July 2008

01/20/2009: Received another RFE for Affadavit of Support Info

02/02/2009: Responded to RFE with brand new AOS based on 2008 tax return (if that doesn't shut them up, dunno what will)

02/19/2009: EAD card received in mail (no updates on Online Case Status ever made)

02/23/2009: AP received (again, no online updates)

02/26/2009: Received interview appointment letter for 4/6/09

04/06/2009: AOS approved for unconditional GC

it is different because this current situation includes an action from USCIS, the cancelation

the previous situation was just lack of action, clearly due to the backlog

besides, USCIS published information on receipt delays
