Blue then green slip then crying!!!!! what is a life?

Hi Vietnam related VJ members

My fiance' got interview on 2-20-08. it took about 20 minutes, smoothly went through with the general question such as when, where you guys met? how you guys communicated? When, where he proposed to you ? any engagement ,where,when, who attended? then they want to see evidences: phone bills, e-mail, chat logs, pictures.......after all of that BLUE SLIP, which said they need:

1- petitioner and beneficiary's birth certificate ( perhap my last name is same as her mother last name )

2- beneficiary's ex-spouse info and address ( my fiance's divorced in 2004 )

3- 2 electronic version of DS 156 form ( vietnam filers : you must go online fill out form DS 156 then print them for your interview not fill out the ones that they sent with instruction package)

I sent by fedex express to her:

- Notarized letter explained why i am not able to obtain my parent's birth certificate because they both died when i were a kid.

- However , i still have my father' s death certificate ( with all the in fo on it such as his father, mother name, adress....) and my parent's marriage certificate ( with all the info about them and my grand parent)

- A certificate of local goverment to assign us ( me and my sibling ) to a charity for giving up when my parent passed away

My fiance' got all of her papers:

- her parent's birth certificates

- her ex information with notarized of local police where her ex is living

- 2 electronic DS156

On 2-28-08 She submitted all of the required documents to HCM consulate office.

After waiting about 2 hours 30 minutes they gave her a GREEN SLIP which said that : your case requires additional processing in our office. You do not need to submit futher documents. We will contact you when we have finished processing your case.

THEN MY FIANCE' IS FEELING MISERABLE

Some of my thoughs were:

- Through interview, with all evidences provided they did not ask for time-line that means our relationship is ok

- The subtituded documents for my parent's birth certificate are ok, because they have all the information that they required to see if you are related to your fiance'.

Why we got GREEN paper? GREEN means denied? administration review? or something else?

Any advices, greatly thanks

It appears your case is under administrative review and not denied. They need time to go over the new evidence you provided them. This may take some time.

Whenever I see a blue-slipped case posted on this board, I am heart-broken. I have been there, done that so I know the feeling of all the hope and hype leading up to the interviewing day. Then the day comes, you are sick-worry, stress-out and anxious. You are pacing by the telephone and the bad news comes. The world stops moving. You are devastated and the waiting game has begun.

However, most of these case eventually approved in the end. That is a good news. I have said several times on this board that any case with previous marriages, same last name ... is destined to be in AR. Yours is no exception. You have done what you must have done so right now, all you do is be patient. It might take days or months depend on the complexity of your case. However, if you do some research on this board, there is one lawyer in VN comes in highly recommended. You should look him up should you need him to, maybe, see it through and expedite your case. Good luck and you have nothing to worry about. Cheer up. I know it is easier said than done but that's the least I could do.

I used to be indecisive. Now I am just not sure ...

What Kevin&Loan, Dave_Thao said is true. Your case while delayed is just that. It's most important to make sure you have all the required evidence for the interview. The better prepared you are, the less likely you will have problems, ie blue slip. Your appointment letter said to have two copies of the DS156 (electronic form), that probably didn't help to not have that. I am really saying this to help those who are reading this post and haven't yet had their interview.

In your post I'm assuming you meant the blue slip asked for your parents and her parent's birth certificate. The Consualte doesn't do a good job of letting you know what you should have, see my consulate review about some of the things left off the letter or just wrong in the letter we got for our interview. Since you both have the last name, that is a known red flag for the Consulate. Having the notized infomation in advance would have been great but I know you can't guess for sure what the Consulate will ask for. Did you not include your fiancee's ex spouse on the forms (G325a, DS230) you did submit? Or did the Consulate want local police report about him since you didn't submit the DS-156?

That said, From what you have sent, I think it's just a matter of time before she gets her visa. Hopefully it'll be short. As the Consulate seems to be better right now at processing cases than in November-January.

While the Green slip says not to contact them, I would anyway. You as the Petitioner have impact on the what the Consualte thinks. They know most Beneficaries want the visa and some may say anything to get one. However, you are a US Citizen and they have to listen to you, they don't have to listen to your fiancee. I found that out when Thi called the Consulate. While not rude, the woman who answered didn't want to talk to Thi any more than necessary. She hung up after answering Thi's question and before Thi could ask another. When I called, they listened to what I said and responded to my questions. They waited until I said I didn't have any more questions before hanging up. IF you haven't heard from them in a week to 10 days, call them and ask what is the status.

If they don't respond in a positive way, I would contact Marc Ellis about what he thinks you should do. He has been very helpful in the past about the issues you are having with the visa.

I feel your pain. Just hang in there and eventually you both will get through with this proecess. We went through alot in this process, at least 3 or 4 blues and a few green slips, 2 medical exams and interviews. It took us a year and half since our first blue back in 2006. I hope your fiancee does not have to go though what we'd been through. I would suggest, when ever you can after your fiancee hear from the Consulate, to fly back and request to talk with the cheif with MC help if you can. Don't let them asking one thing after another, as for my case each time they asked for more info, it took at least 2 or 3 months before we heard from them again.

Hello, VJ friends

I tried to call ME. He told me that now it is too early to hire him. Because I need to let COs have time to check and review document which we submitted. If after that time, I dont have any answers from Consulate, call him. What can I do in this time, just wait?. I will call Consulate, but I hear that it's hard to talk with CO. So, I think I will contact with Congressman and need an inquire, but when is the suit time to do that? This time is very terrible for me.

Lawyer . . you need a lawyer . I'd recommend Marc Ellis . He helped me out before .
