Affidavit of support with initial petition?

Hi there, I spoke to a lawyer my friend referred me to today on the phone (visalaw / Bernard P. Wolfsdorf office) who claim to be the 7th largest immigration law office (and charge $3,000 by the way!). He mentioned something interesting which I wanted to ask the forum.

He said that they usually submit a full package to USCIS which not only includes what is required for the petition, but also for the Embassy interview (such as the affidavit). What do you all think? Is it necessary? Have you done it? What is required for the Embassy interview?

First, as stated in your other post by others, don't hire an attorney. Not for $3000. Not for $300.

No, that is not necassary, and many of us have done it by ourselves. Your fiance's interview will not be done at the Vietnam Embassy, but at the Consulate in Ho Chi Minh City (Saigon). All consulates have slightly different requirements, but from first hand experience you happen to have chosen one of the hardest.

The two most important things you will need at the interview are

1) Lots of evidence to support your relationship (anything from plane tickets to love letters and pictures)

2) Proof that you can support your fiance when she arrives in the US. This is where the I-134 comes in. You must meet minimum poverty guidelines. The use of co-sponsors seems in general to be frowned up by the HCMC consulate.

Hi there, thanks for the quick reply. I don't intend to hire a lawyer, but just thought it was interesting to mention his fee as I was surprised. I was interested in whether it is advised to include the additional info, but it sounds like it is not needed yet (I was just being #######).

Fortunatley she will be able to process her visa at the London Embassy as she currently has residency in the UK as a student getting her masters degree. The US embassy in London confirmed (via email) that she could do it as long as she has leave to remain during the processing period. Hopefully this will help us.

Well in that case your biggest hurdle will be obtaining a police certificate from Vietnam while she is living in the U.K. The U.K. requires a police certificate right? :huh: If they do then you might start trying to get this at the same time you file the petition.

I have a lawyer for our K1. My lawyer included affidavit of support I134 in the K1 package. You might have already learned from this forum that including I134 is not necessary with the K1 package, however, lawyers like to include it...for no particular reason...apparently. Probably they are demonstrating their preparedness and thorough analysis of the case...such as running poverty guidelines with the petitioner...

I-751 process:

4/06/09: Mailed I-751 to VSC by Express mail

4/07/09: Received by VSC

4/17/09: Check clearance.

4/20/09: NOA1 received in mail (receipt date: 4/08/09)

4/30/09: Biometric appt. letter received (appt. on May 15th)

5/05/09: Walk-in biometric done

9/02/09: Approval Email (touch on USCUS site)

9/03/09: Approval letter received (decision date: 8/27/09)

9/09/09: Touch, but no change in status on USCIS site.

9/11/09: Green card rec'd.

And remember attorneys charge by the hour and for every form they complete. So by completing the I-134 at the begining of the process when it's not needed they are billing you for unnecessary work! ;)
