What is Denial per 221(g)??

My wife has been sent back and forth to the Embassy, and I am quite stressed and confused as to what's gonig on, so anyone on here who can offer some advice, I would really appreciate it.

After the interview at the Syria Embassy my wife was given a letter that said the visa application was denied under INA 221(g) and that additional information was required before adjudicating the app.

So what does this mean? What is INA 221(g)?? What does adjudication mean??

Adjudication basically means when they start looking at your application to process it.

It means what it says. They won't issue the visa until after they have the specific additional information they asked for on the 221g letter. When they get it, they'll "adjudicate" (consider and decide).

Your next step is to get them exactly what they asked for and deliver it by the method they gave you for doing so.

Follow thru with what they ask you for and you should be fine in time.....its not a denial completely ,yet, but do follow their instructions, the other form of the 221g is return of the application.

hi,

I also had a 221g .... they give 221g when they want additonal information from the petitoner as well as the benefciary...on the 221g paper which is signed by the consular officer... it will be mentioned what they require... submit them the documents to them... you have a period of 1 year to submit stuff for 221g... submit them asap so you can get your wife to u. 221 g DOESNT MEAN YOUR VISA IS DENIED. IT JUST MEANS YOUR CASE IS ON HOLD.

Feb 1,2007 - I-130 Reached USCIS.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

Dec 1, 2007 - Medical Exam .

I GOT IT

Jan 16 - I am in USA

April 15 2008 - Get my Drivers License.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1

Timeline

Your 221(g) is a request for additional information. What is the information they are requesting? Provide the consulate with the additional information they want and then the Consulate Officer will re-examine the paperwork and approve or deny the application.

But you must promptly forward their request for additional documents.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

Thanks everyone - I hope that after submitting the docs they are asking for they can issue the visa to my wife, this sure has been one long stressful ride...They are basically asking for more proof of relationship, including a signed and notarized letter from me describing the relationship. I spoke directly with the consul at the embassy and got the details of why and what they wanted, so hopefully having that discussion with them that will help toward getting approval (crossing my fingers)....

On another note, I just received a notice from USCIS that my K-3 has been approved and will be forwarded to the Embassy for processing (kinda late in the game now)...we are already almost at CR-1 Visa approval and now they send me K-3 saying that petition being forwarded to Embassy and within a week they will be sending my wife a packet stating what they want from her etc...

Does anyone know how this will affect my current CR-1 Visa process? I really feel K-3 is late in game and won't do me any good now, and wondering how it will interfere with the current status of awaiting the CR-1 Visa - when embassy gets this, will they wonder and be confused, will it negatively impact our CR-1 Visa status currently??

Please advise.

Once the Embassy/Consulate receives the K3 case file, they'll see they already have the CR1 case on station and simply cancell the K3 case. A K3 visa cannot be issued when an immigrant visa is immediately available. At the Consulate level, this means immigrant visa case is on station. USCIS seems to have begun interpreting this as "when an I-130 is already approved" for I-129F for spouse petitions filied after July 28, 2007.

Please give us a timeline or at least tell us your petition filing dates.

5/11/07 I-130 Sumbitted

8/27/07 I-130 Approved and sent to NVC

9/21/07 Sent IV Fee Bill to NVC

10/18/07 Sent AoS to NVC

11/19/07 Sent DS-231 to NVC

12/11/07 Case Complete.

2/3/08 Interview at Embassy - they asked lots of detailed questions. They asked to see more proof of relationship and phone bills etc, told my wife to bring this information back when she gets it

2/5/08 My wife dropped off the phone bills at Embassy. They took her fingerprints and told her to come back 2/19/08 for decision.

2/19/08 My wife went to Embassy - they gave her 221(g) letter telling her they needed more proof of relationship, letters, cards, photos, and a signed/notarized letter from me describing relationship.

2/20/08 My wife dropped of the letters she had, all the photos and the signed/notarized letter from me that describes the relationship. They told her to come back 3/9/08. That is where we are at right now, waiting and hoping that when she does go back on 3/9 that they will finally issue the Visa. God I hope this long frustrating journey ends with Visa issuance...

So what do you guys think of my case? Is it a good sign that they took her fingerprints? I mean, we are right there, we should be getting approved, they are holding it up for what reason I don't know why....

Please advise.
