I have this dumb but critical passport question. I am US citizen and I am planning to file I-130 for my spouse. The passport that my spouse has to take to interview and copies of the passport that my spouse has to submit should have her new name after marriage (i.e. my spouse will have my first name as her middle name and my last name as her last name). Her passport now should NOT have her original name before marriage (i.e. her original last name and father's first name as middle name). Is this right?

In think the best practice is for the passport to bear the current legal name.

Since, we have our marriage certificate issued by govt. in hand, my spouse's current legal name would be

<my last name> <spouse's first name> <my first name as middle name>. However, my spouse's name is not shown in this format on marriage certificate, since her original name (with father's name being middle name) is written on marriage certificate. It's after marriage certificate is issued, her legal name becomes in the format I have written above.

I put my wife's original name on the I-130 but then I found out that the people are putting in new name on the I-130 and having their wife get a new passport under the new name. I talked to USCIS officer and he said the wife has to choose whether she wants to come to U.S. on the new name or the old name. If new name, then she needs to have a passport in the new name. For me, my wife already had a passport in the old name and I had put that on the I-130 so I'm keeping it that way. I'm going to change it once she becomes citizen. If I was going to file it again, I would say put the new name on the I-130 and have your wife get a new passport. Then you won't have to worry about changing the name once she gets here. I'm just avoiding this route since I don't want to delay my application processing.

05/05/2008 - DS-3032 E-mailed.

05/05/2008 - Paid AOS Fee online. Payment Status: IN PROCESS

05/06/2008 - AOS Fee Payment Status: PAID. Printed coversheet with barcode.

05/06/2008 - AVR: NVC received AOS Fee bill on 05/06/2008. We will send further instructions within the next few weeks.

05/10/2008 - Mailed I-864EZ Packet.

05/13/2008 - DS-3032 Acceptance E-mail Rec'd. AVR wasn't updated yet. IV Fee Bill Not Invoiced yet.

my husband got the NOA-1 with my new last name NOW i need to go for a new passport

but my husband has summit the photocopy of my old passport with packet 1- 130 ..

would that be a problem ,,

Any comments would be greatly appreciated.

Why did your husband send copy of your passport? It's not required. I would get a new passport though since your application had the new name.

If you have your marriage certificate... apply for a name change from the passport office where your wifes passport was issued and you will get back the passport in 7 working days and there will be a fees of 300 Rs.

In the I-130 application mention your wifes new name with husbands last name attached to it.

Feb 4,2007 - I-130 accepted > Get USCIS case Number NOA1.

May 8 ,2007- GET NVC Case Number > NOA2.

June 16 ,2007- Get Order from NVC to pay 70$.

July 2 ,2007- Get DS-3032 in India.

July 7,2007 - DS-3032 choice of address agent entered in NVC.

July 14 ,2007- Get I-864.

July 18 ,2007- I-864 Enters NVC.

July 29 ,2007- Get Order to Pay 380$ fee.

Aug 3 ,2007- 380$ Fee Reached St Louis.

Aug 25,2007 - NVC & St Louis People receive photocopy of my payment with USPS receipt.

After WAITING for 37 days.

Sept 10,2007 - 380$ fee encashed.

Sept 24,2007 - Receive DS-230 in Mail.

Sept 25,2007 - DS-230 despatched.

Sept 26,2007- DS-230 Delivered.

Oct 1,2007 - NVC has DS-230.

Oct 12, 2007 - DS-230 Reviewed. Case Complete

Oct 16, 2007 - Case at Embassy.

Oct 25, 2007- Interview Letter Despatched from Embassy.

Nov 3, 2007 - Recieved Interview Letter.

Dec 1, 2007 - Medical Exam .

I GOT IT

Jan 16 - I am in USA

April 15 2008 - Get my Drivers License.

I-751 Lifting Conditions at California Service Center

November 12, 2009 - I-751 Sent via USPS Express Mail

November 13, 2009 - Receipt of I-1751 Fee

November 20, 2009 - Arrested on Domestic Battery(Had argument with wife)

December 18, 2009 - Biometrics Completed at 9 am.

January 13, 2010 - Receive I-797E Notice for more evidence

February 16, 2010 - Mail reaches Californa Service Center( Next day of Preseidents Day)

February 19, 2010 - Card Production Ordered. Status now IR1
