Well, you can apply early, like I did, but you'll be put under more scrutiny. If you're thinking about applying after 3 years make sure that you have things like joint utility bills or name on the renal/mortgage. Also make sure that you can show a bill for each year you are here. My name isn't on any of the bills and simply getting my name put on one wouldn't be enough, I had to show the three years worth.

Married: 08/05/2007

I-130 sent CSC: 08/09/2007

NOA 1: 09/05/2007

NOA 2: 02/19/2008

NVC case number assigned: 03/04/2008

Case complete at NVC: 05/12/2008

Case sent to Consulate: 05/28/2008

Consulate received: 06/03/2008

Interview & Approval: 07/07/2008

Passport with Visa received: 07/11/2008

POE San Francisco: 09/15/2008

ok, thanks, my name's not on the utility bills simply because I was at work when Rob went to have them turned on, but both our names are on the apartment lease.

They are terribly slow at VSC. I think they are well outside the normal processing times with that. I am not even thinking I will hear anything more until next summer. There are quite a few who are thinking they may need an extension on their extension.

We are off in December to TN to get the biometrics done. I hope the weather cooperates!

well, i had my biometrics appointment early october, so i assumed my petition was fine and i was just waiting for the new GC, but today i received an RFI :(

i'm worried because we don't have much in both our names, apart from our lease and bank account/credit cards - all the utilities are in my husband's name. i don't understand why they would send me for biometrics first???

I've seen this happen in a couple of the threads, for ROC. I would have thought that having the biometrics letter sent, and completing them, meant that you were ok as far as info. Seems that you can still get an RFE :( It looks like they don't really check through petitions for completeness, the machinery just cranks out the letter a few days after they get your bits and pieces.

What did they ask you for? The wording can sometimes be a bit vague.

I can explain it to you. But I can't understand it for you.

the letter just asked for all the same stuff as the initial petition - proof on an ongoing relationship, in the form of shared address and shared assets. my husband managed to get pg&e to put my name on our power bill, and also on our credit card bill (we have joint credit cards but my name doesn't show up on the bill). we're also thinking about taking out a cheap life insurance policy.

i don't know what more we can prove that we didn't already prove in our initial petition.

We didn't have a lot either. We neither rent nor own, so we live with his Mother, so no lease or deed. No bills either. We sent the tax transcripts, copies of our drivers licenses that show this address, car insurance paperwork with both names on it. I had mail come from the Canadian Embassy that showed this address, so I sent that sort of thing. Bank statements covering the last 3 years, and I had the MIL sign a letter that stated we live here, and she obviously knows we are married. I sent about 5 pics in as well.

This was a good post I thought, Brother Hesekiel put it down well and I tried to follow that as much as I could.

http://www.visajourney.com/forums/topic/263269-i-751-rfe/page__st__15

I'd send them anything new you can think of. I did read where a couple sent the same things, but highlighted some..such as she wasn't on the lease, but the joint bank account showed the rent payments coming out of the account balance they shared.

I can explain it to you. But I can't understand it for you.

Hey Guys,

I have a very different type of question. My daughter came over for a 2 month visit from Auckland and met the guy next door, fell in love and now wants to come back as they want to get married (Trying not to smile like a cheshire cat :D )

So my question is this, would it be quicker for me to apply for her as an unmarried daughter over 21 or for her fiance to apply for her k1 visa?

Or can we do both at once and see which one is quicker. It's just that I've been reading that the wait time for unmarried children over 21 can be over a year and sometimes a lot longer, while the k1 for me was quicker, about 7 months.

Ok I'm such an airhead, I have somehow managed to make myself two member names and now i can't figure out how to delete this post and put it in under my other name.

I think you would need to be a Citizen before you could petition for her. So, I guess that is about another year right off the bat? It is probably quicker for him to do the K1. Bonus for that it, you already know all there is to know pretty much about how that one is done :P

Congratulations. To Kelly AND you <3 !!!

I can explain it to you. But I can't understand it for you.

Reading around I may be wrong, it is possible it seems. But a lot longer than a K1.

I thought it took around 7 years to be able bring an unmarried son or daughter over the age of 21 here, which i thought was a very long time.. so maybe i read it wrong.. I think it would probably be quicker for them to do the K1 visa. Congrats to your daughter!! (and you) :star:
