Need Some Help!!!

Ive been reading on the forum all day..what a great site. I am a Canadian citizen who resides in Ontario and my boyfriend lives in Georgia. We've been dating for some months now, but its been so hard cuz we live so far away. I have visited him twice and he is planning on coming here soon. We want to take this relationship to the next level but its hard due to the distance. I am willing to leave Canada to get closer to him because i really think he's 'the one'. To make a long story short, what is the quickest way to get there and be able to work? Can u work in the US if you've been approved for a K-1 visa? And what is the average wait time for the visa? Thanks soo much to anybody that replies.

I don't mean to be discouraging, but I think you need to be certain he is "the one" because once you come in on a K-1 visa you have to get married within 90 days. As for the question of can you work, it is allowable but not all POE give you the temp EAD and even if you do get one, they are not valid very long so many employers do not wish to train someone who may have to stop working shortly after.

You can apply for work authorization document (EAD) after you're married, usually it takes 60-90 days till you get it approved. So you should be prepared for a few months that you wouldn't be able to work after you come to the US.

The wait for K-1 visa varies, depending on where your fiance lives and what service center it's gonna go through and what embassy will conduct the interview, you can check the processing times here: https://egov.immigration.gov/cris/jsps/ptimes.jsp and get some idea how long it takes to get the I-129f approved. Also check the immigration timelines on this website and the guides and FAQs are very helpfull :D

The K-1 visa probably is the easiest way -- though, you have to get married within 90 days, so you should be REALLY sure this is something you want to do because if you don't get married, you have to leave the country. And if you overstay or violate the terms of a visa, you will become ineligible to get one ever again (or so they say -- I don't really know for sure if that's true). They are some other options -- if you're in school, you could maybe apply for a student visa, which would last as long as you're a student (I think you have to be enrolled for more than 18 hours a week of class time, and you can't work), or you can look for jobs in the area near to where your boyfriend is and see if they will sponsor you for a work visa. Anyway, look at this site: http://travel.state.gov for various options you may have.

11/04/2006: Greencard arrives in the mail! :-D

Look at the Guide tab on here. It will go through step by step how to get everything ready to file the petition. Your boyfriend would be the one filing the petition but it requires documentation from you as well. The Guide section is very informative.

As a Canadian you're allowed to go to the US for up to six months out of the year... so if you just want to go and visit for awhile it's quite permissable. You have an advantage because you get twice as long in the US as people from overseas countries... if I was you I'd use that time wisely.
