k-1 visa, I-134 question

Hello All:

This seems like a great site! I have not filed my petition yet, probably next month (in Vermont). I met my lovely fiance quite by accident in September and she has just agreed to marry me (I have met with her 3 time so far in her native Ukraine and will again in 2 weeks :)

Any advice is appreciated. I gather I do not need an attroney from the posts I have read. I do not have any "unusual" circumstances. But I do have a question regarding the support affidavit.

Prior to August of last year, I was self employed for 7 years. I now have a "regular" job with salary and documentation. I notice on form I-134 that IF I am "self-employed" I must attach a copy of last year's tax return. Since I am no longer self employed and can verify employment and salary now, do I still need to file a tax return? There is some mention of it in posts, comments, etc., but the instructions indicate only if "self-employed". What has been the experience of others?

My question is based on tax codes. When self-employed it is beneficial to show as much "income" as possible as a business expense (which it legitimately IS) but this has the effect of reducing personal income. It makes a personal 1040 look "worse than it is" so to speak. I would prefer to provide documentation of my current salaried employment which "looks" much better, though really the same. Any advice? Do I need to file a tax return if I am currently working as an employee and can document that?

It's not absolutely required but I would both include a tax return and document current income. Declared income can be annualized current income. It need not be specifically for a calendar year or past 12 months.

Just for clarity, I take it you are asking about including a copy of a tax return with the I-134, not "filing a tax return". Of course you'll be filing a return, regardless of any immigration issues.

Facts are cheap...knowing how to use them is precious...

Agree with the previous post. You'll be filing 2007 tax return anyway - defefinitely before your fiance will need a copy of it for her interview, so what's your concern right now? My fiance is self-employed too, and to supply the Affidvit of Supporrt, I submitted his 2006 tax return copy, bank statements (both checking and saving accounts), and some other savings. Mostly important, that your income should be 125% of the poverty line which is now around $17,500. If you'll going to have only two of your in the household, your income should be at this level or higher. That's it!

It's not absolutely required but I would both include a tax return and document current income. Declared income can be annualized current income. It need not be specifically for a calendar year or past 12 months.

Just for clarity, I take it you are asking about including a copy of a tax return with the I-134, not "filing a tax return". Of course you'll be filing a return, regardless of any immigration issues.

Ok but you won't be "filing" an I-134. You don't send it with the petition. You get it to the beneficiary who later provides to the Consulate. Your tax return and other documentation are "included", not filed. Later you spouse would "file" your I-864 with her I-485 to adjust status in the US.

Side note to the above. Is there a recommended amount of copies of the tax returns (ie 3 years worth) that they want to see? I couldn't find this anywhere.

Only one year of tax return you have to show for I-134, your last year. My fiance sent me his 2006 tax return info and it was enough. Additionally, I had some bank statements and some other savings documents photocopied, and it was ok.
