I-134 Affidavit of Support. Evidence

In Part IIA of the instructions they required a "statement from a officer of the bank or other financial institutions where you have deposits"............

I've asked my banks to supply me this info....does anyone have information as to whether I need to do this with my retirement funds? this would be a lot more onerous

It is my understanding that this letter from the bank is only required if your income is below the 125% of poverty guidelines, though each consulate has their own rules. I asked my bank about this letter, and not only do they charge $25 for it, they said it would not provide a sum of all deposits (only a monthly average of deposits and withdrawals). I'm sending my fiancee a copy of my last year's worth of bank statements, even though I am well over the 125% level. My fiancee is the nervous sort and wants every document they could conceivably ask for with her at the interview.

Bank data is only needed if income falls below 125% povertyline, and you need to use the asset of bank account to make up the short fall.

One thing about I-134, the directions included with I-134 are very old, USCIS has no reason to update them since USCIS has no application for that form.

The consulates tend to treat the I-134 like a mini-I-864 as so prefer the same financial evidence as the I-864.

In our case this what the I-134 included.

  • I-134 signed and notarized.

  • SIMPLE Tax transcripts from the IRS for past 3 years, (Redundant for the (1040,W2,1099) but are free from the IRS http://www.irs.gov/faqs/faq1-6.html

  • Photo copy of IRS form 1040, and W2s for past 3 years (Not necessary if you provide the transcripts)

  • Letter from my employer stating annual salary, job responsibility, and that is full time, on company letterhead.

  • Photo copies of past month or so of pay stubs up to a few weeks before the interview.
My income was well above the povertyline so I did not include any asset data (LIKE BANK STATEMENTS or property values).

If your income exceeds 125% of the povertyline when counting yourself, prospective immigrant and any dependents, then don't bother with assets (401K, Bank balance, Stocks etc..), it is just extra un-needed data to provide, the consular officer is most concerned with INCOME.

Is now a US Citizen immigration completed Jan 12, 2012.

Thanks, do you OMIT them (401K, Bank balance, Stocks etc..), from the form then? ...my income is well above the poverty line....

Yes, you leave it off, anything on the I-134 requires financial evidence attached to back up the numbers.

Hi,

I'd like to know where did you get this info? I am asking my fiance to send me bank statement from an officer of his bank as specified in the instructions in I-134 as supporting evidence. He is self-employed and for 2007 he is making $30,000. I understand his income is above the 125% poverty line for family member of 2. Based on your post, will I skip that requirement? Thanks.

Timeline

Quick question about the I-134. I graduated from undergrad in 05/07 and I now have an income that is well over the poverty limit. But my tax returns over the past several years show me making less that $4,000 annually as I was a student. I checked the I-134 requirements and it seems that as long as I can show evidence of employment with a letter from my employer and several pay stubs I will be good to go. Am I right here? :unsure:
