Hey everyone

We found out today that we were approved on Thursday (31 Jan). We filed in September and it was right on schedule according to the estimated timeline.. about 6 days early, actually.

I've got a few questions now, though:

1. We are some of the lucky few who are actually managing to stay together (in Australia) throughout this whole process. We actually want to stay in Australia for the rest of this year and then move to the US and get married next year. This is going to sound really spoilt, but is there a way to postpone things? As I understand it, we have four months to gather together the documents we need for the interview.. correct? That takes us to about June. If the interview is in June and all goes well, we have six months to get to America.. that takes us to December. That means the marriage must occur between December and March which is winter. We wanted to get married in summer, preferrably June.. is there a way anyone can think of to do this. It's so NOT a big deal if it can't happen, obviously we just want to be together.. but if anyone can think of a way, let me know.

2. Do I need the hard copy of the NOA2 to be sent to us in Australia? It'll be sent to my fiances address in America (his mums house).

3. My fiance and I are working here in Australia.. so he has no funds in America. We're going to get his mum or dad or sister to sponsor us (all make above $60k p.a.). Is this ok?

4. He hasn't worked properly in America for about two years now so his tax transcripts won't show much income. This is only necessary/important if he was going to support me by himself, right? If we have a co-sponsor, this won't be an issue?

You can delay sending in the response to Packet 3. I waited 3 months before sending in mine. You can also request a delay in the issuance of the visa. The day mine was approved at the Consulate, we discussed this with the Officer. He said that I could send him my passport when I was ready for the visa to be issued. I have a vague recollection of it being up to 3 months or something. Can't quite recall at the moment.

You do not need the NOA2 to be sent to Australia. You won't need it until you get to the AOS stage in the US.

Timeline

1) Correct, you could always have marriage in a warm place like Hawaii in the winter.

2) NO, it is not needed for visa interview, and should be kept in a safe place, it will be needed later for adjustment of status filing.

3) YES, but US citizen petitioner must also provide an I-134, and can get it notarized at the consulate in foreign country.

NOTE US Citizen must file IRS returns every year even if exempt from paying tax on foreign income.

4) Correct, using a co-sponsor should overcome this.

The four months is not a factor. Consular officers routinely extend the validity of approved petitions. Delaying P3 return and requesting say an August interview when you do return it, is perfectly acceptable.
