Need Help on filling out I-864 for my Co-Sponsor..

One more thing.. As mentioned on I864EZ you only need 1yr ITR..

How about for co-sponsors.. How many ITR's do they need?

Does he need to get a Employment Certificate as well and paystubs?

IR-1 Visa for Wife

NVC Case Complete = January 2, 2008

Received Packet 4 here in the US (Interview Packet) = January 18, 2008

Case Left NVC Forwarded to USEM Manila = January 23, 2008

SLEC Medical = Jan 31 and Feb 1, 2008 (2 days)

USEM Manila Interview = February 20, 2008 @ 8:30am = DONE! (Status: 2 Months wait is over APPROVED)

CFO Guidance & Counseling = April 17, 2008

Visa in Hand = April 18, 2008 (Our Wedding Anniversary)

Arrival in the US and POE = April 23, 2008 JFK Intl. Airport New York City

Social Security Card = May 2, 2008

Green Card in Hand = August 18,2008

requirements are the same for all sponsors. additional two years ITR and W-2's, employment letter and pay checks stubs are not required, but good idea to if you feel it can help your case.

Its not for me... Its for my brother who is co-sponsoring me for my wife..

Well Actually I already submitted the I864 last year.. I submited 04, 05, and the latest 06 ITR which was above the P-Line.

But my 07 is below the P-Line so I'm just preparing this in case the consul ask for my latest ITR..

I know.. I know.. they didn't ask for financial docs on the interview.. I have seen 3 IR-CR interviews already and no questions regarding financial docs were asked..

Just want to be prepared for any worst case scenario..

there is a reason why the CO no longer ask for financial evidences--they already have it in the packet sent by the NVC. Since you have already been declared by the NVC as documentarily qualified, the only thing that the CO needs to confirm during the interview is your identity, relationship and the eligibility of the petitioned immigrant.

anyways, if you still insisit on having your brother sign the form, he should be filling up and signing the I864A and NOT the I864EZ. to qualify for the I864EZ, all the following conditions must concur:

1. the one signing should be the petitioner of the intending immigrant;

2. the petitioner is using his earned income or retirement as evidenced by W2s; and

3. the sponsored immigrant is the only person immigrating based on the visa petition.

absent any of the above would automatically disqualify your brother from using the said form.

there is a reason why the CO no longer ask for financial evidences--they already have it in the packet sent by the NVC. Since you have already been declared by the NVC as documentarily qualified, the only thing that the CO needs to confirm during the interview is your identity, relationship and the eligibility of the petitioned immigrant.

Well the PDF doc for the I864A is not working.. So I just used the I864 regular..

Like I said.. I am just preparing for the worst case scenario.. As I stated on my last post.. I have seen 3 IR-CR Interview and no Financial docs were asked.. So I totally believe you.. I am just being cautious since I know for a fact that I didn't meet the above P-Line for 07 and barely made it to the top on 06..

When I open I864A it says "the file is damage and cannot be repaired."

Oh.. My bad.. So No Co-Sponsor can use I864ez..

Since I can't open I864a I guess I 864 regular is alright? :unsure:

Cause it has the choice of Joint Co-Sponsor..

my mistake. the I864A form should only be used by a Household Member and to be considered a household member, once should either be:

-A relative who has the same principal residence as the sponsor and is related to the sponsor as a spouse, adult child, parent, or sibling;

-A relative or other person whom the sponsor has lawfully claimed as a dependent on the sponsor's most recent Federal income tax return even if that person does not live at the same residence as the sponsor;

-The intending immigrant, in certain circumstances. (See "How Can the Intending Immigrant Be Considered a Household Member"?)

since i have no idea if any of the above applies to your brother, you are safer using the I864. :thumbs:
