Hi..

I posted this with my friends permission as it is a very sensitive matter.

I have a friend that is a Vj Member that got a 212(a)6©1. according to the letter she showed me it sayes the following from the embassy :

Material Misrepresentation

You have manipulated documents on your Marriage paper and misrpresented material facts in your immigrant visa case. It has come to the attention of the US embassy that your marriage papers was registared in an area in which the wedding did not take place and your wife is not a resident of the place that the marriage was registared. This application is clearly exclusively for the purpose of immigration.

Material mispresentations violate subsection 212(a)6©1 of the immigration and nationaliy act of 1965

and result in a lifetime ban from the United States. Your will be returned to the National Visa center with a request for revocation. if you wish to appeal this decision, you may do so directly to the national visa center.

The question she has been wondering is what does it mean to Revoke? she is not to clear on what happens next. she also tells me she has written letters to her congressman. Does she refile her petition? any ideas?

she filed for a Ir1. she has been married over 2 years. I dont know what I can tell her to dry her tears and mend a broken heart.

There is a right of appeal.

Not to be harsh, but were they right? If they're right, then the policies are doing what they're supposed to. If they're not right though, by all means appeal.

My thought would be if there really was a misrepresentation, then it may also matter if it was an intentional misrepresentation or not. Also, I'm sure if they've gotten that far, then they've probably been through administrative review also, at which point I would think that they would have accurately figured out what's going on (although this is USCIS, so a lot of stuff probably happens that isn't logical). Obviously I don't know this because the information hasn't been clearly presented, but this is just my guess from the situation. Also, nothing against Pakistan, but if your friend or friend's fiance is also from Pakistan, it can't help, because it's one of those countries that I'm sure they look at a lot more just because of international relations. It would help a lot to have more details.

Innevitably, when something like this happens, a lawyer probably is the best option, because at this stage they're hanging by a thread.

according to this lady she married in F section. not G section.

the marriage paper said G section and that she LIVED there. its a dayum mess.

It appears that her only option at this point will be some sort of appeal although I don't know what exactly that is and how it's done. Normally, the CO's decision is final unless it involves a matter of interpretation. They won't dispute a matter of fact. So I really don't know how to advise you-as I suggested last night, make sure she attends Laurel Scott's chat tomorrow. She will be able to provide the answers she needs.

I don't understand this part. Where is she a resident? Is she a USC? Is it illegal to get married in one city and register your marriage in another city???? I'm confused.....
