Original Greencard Request from USCIS

Hello All-

We submitted our application (with all relevant documents etc) in the end of March for the removal of conditions. I got a letter a week later informing of the extension to work and travel for an year.

Today (apr 24 2006) I got a request from USCIS requesting me to send them my ORIGINAL Green Card (I-551). It is quite strange as no where in the filing instructions did I see them requesting original Green Card. I have checked the letter and it is genuine (with LIN # and my A#). The mail back address is also of USCIS Nebraska office.

The letter says to submit the folowing, if they are not already submitted in order for the immigration officer to review the application.

1) Documents to establish marriage was conducted in good faith....

2) Two color photos

3) Original Green Card

Now I had submitted both 1) and 2) but never thought they ask for original green card.

I am wondering if anyone else has received a similar letter.

Any information will be helpful.

I've heard of lots of people getting that lately. Normally it speeds up the process—they can just send you a new 10-year card instead of you having to go in person to hand over the old one. In other words, scary as it sounds, it's a *good* thing. Just make sure you make copies of the card and the letter to have on hand.

I've heard of lots of people getting that lately. Normally it speeds up the process—they can just send you a new 10-year card instead of you having to go in person to hand over the old one. In other words, scary as it sounds, it's a *good* thing. Just make sure you make copies of the card and the letter to have on hand.

You have your I-751 in Nebraska. That is normal for Nebraska. Just send them the card and you will get your 10 year card in 1.5 months (if your case is straight).

Please post when you get approval (10 year card) so that others can know how long it takes.

I've heard of them requesting that, and it's almost certainly a genuine request, and complying with it will almost certainly be a good thing that will speed things up for you.

However, if you comply with their request, you are clearly violating paragraph d of INA 264. Once they issue your Green Card, the law says you must keep it in your possession. INA 264 does not have any exceptions allowing the USCIS to take the card back from you before they issue you a replacement.

I realize that many people have complied with these procedures with no harm, and that regardless of what INA 264 says, no jury of your peers is going to convict you of a misdemeanor for following the orders of the USCIS like that. But still, I wish the USCIS would revise their procedures to comply with the law, or else Congress should change the law to allow for the USCIS procedures.

05 Apr, 2004: I-130 Sent to CSC

13 Apr, 2004: I-130 NOA 1

19 Apr, 2004: I-129F Sent to MSC

29 Apr, 2004: I-129F NOA 1

13 Aug, 2004: I-130 Approved by CSC

28 Dec, 2004: I-130 Case Complete at NVC

18 Jan, 2005: Got the visa approved in Caracas

22 Jan, 2005: Flew home together! CCS->MIA->SFO

25 May, 2005: I-129F finally approved! We won't pursue it.

8 June, 2006: Our baby girl is born!

24 Oct, 2006: Window for filing I-751 opens

25 Oct, 2006: I-751 mailed to CSC

18 Nov, 2006: I-751 NOA1 received from CSC

30 Nov, 2006: I-751 Biometrics taken

05 Apr, 2007: I-751 approved, card production ordered

23 Jan, 2008: N-400 sent to CSC via certified mail

19 Feb, 2008: N-400 Biometrics taken

27 Mar, 2008: Naturalization interview notice received (NOA2 for N-400)

30 May, 2008: Naturalization interview, passed the test!

17 June, 2008: Naturalization oath notice mailed

15 July, 2008: Naturalization oath ceremony!

16 July, 2008: Registered to vote and applied for US passport

26 July, 2008: US Passport arrived.

Hi. It's funny because just today we received the exact same letter and I was about to post on this forum until I saw your inquiry. I'm glad we're not the only ones who received this as I immediately thought it was a scam of some sort. Well, now I can rest easy.

Just wondering for those of you who recieved the same letter, did you send the orginal green card in the Special envelope that they provided or did you send it to the address that they mentioned in the letter since they were two different addresses.

There are not too different. I sent to the one that was in the letter, since I used priority mail envelope. But, you can, as well send to the one on the envelope. The come to the same place (just different mailbox) and they will get it anyway.

HELLO LADIES AND GENTLEMEN!

I WOULD LIKE TO SHARE THE SAME INFORMATION WITH YOU ABOUT THE RECEIVING A YELLOW COLOUR LETTER FROM THE NEBRASKA SERVICE CENTER ,WHERE THEY ASKED ME TO SEND THE ORIGINAL CONDITIONAL CARD,2 PHOTOS AND THE EVIDENCE ABOUT OUR MARRIGE.

THE THING IS THAT I;M STARTING GETTING WORRIED RIGHT NOW AND I WILL EXPLAIN WHY.

HERE IS THE HISTORY OF MY CASE BEGINNING FROM THE I-751 PROCESSING.

1) I -751 FILED ON JANUARY. RECEIPT NOTICE RECEIVED FOR THE JANUARY,26,2006 WHERE IT STATES THAT MY CONDITIONAL CARD WAS EXTENDET 1 YEAR AND TRAVEL AND WORK AUTHORIZED.

2) YELLOW LETTER HAS ARRIVED ON FEBRUARY,2006, WITH THE REQUEST TO ATTACH THE ORIGINAL CONDITIONAL CARD TO THE BOTTOM OF THE LETTER.SO,WE HAVE ALREADY DONE THAT AND SEND THE CARD WITH THE ORIGINAL YELLOW LETTER TOGETHER RIGHT IN A 2 DAYS AFTER WE HAVE RECEIVED A LETTER.THAT WAS SENT IN THE MIDDLE OF THE FEBRUARY,2006.

WE HAVE SEND THE ORIGINAL CONDITIONAL CARD ONLY. ,AS ALL THE EVIDENCE AND EVEN 2 FRONTSIZE PASSPORT STYLE PHOTOS WERE ALREADY INCLUDED IN I-751 FILE . WE WROTE A SEPARATE LETTER TO THEM EXPLAINING ABOU THAT . ALSO THAT SEPARATE EXPLANATION LETTER WAS SENT WITH THE CONDITIONAL CARD AND THE YELLOW LETTER TOGETHER ON FEBRUARY.

SO THE QUESTION IS ,DO YOU THINK THAT WE SHOULD OF SUBMIT AN EVIDENCE AND THE PHOTOS ALL OVER AGAIN ,SECOND TIME ,DUPLICATE?AS WE DIDN;T DO THAT.

I;M STARTING GETTING WORRIED ABOUT THIS SITUATION AS ITS A MONTH OF MAY,2006 ALREADY AND SINCE THE TIME WE HAVE SEND THE ORIGINAL CONDITIONAL CARD ON FEBRUARY,2006 I HAVENT RECEIVED ANY MAIL FROM THE INS. SINCE I NO LONG HAVE MY I-551 CARD AND IT WAS EXPIRED ON APRIL 28,2006 ALREADY. WHAT SHOULD I DO?

IS THAT A GOOD REASON TO BE WORRIED ABOUT?

I WOULD LIKE TO HEAR EVERYBODY 'S OPINION AND ANYBODY WHO HAS THE SAME PROBLEM A I DO PLEASE REPLY AS WELL.

ALSO ANYONE WHO HAS ALREADY RECEIVED THEIR 10 YEAR CARDS AFTER SENDING AWAY THE CONDITIONAL CARDS TO NEBRASKA ? ,AND WHEN DID IT HAPPEN ?HOW LONG DID YOU HAVE TO WAIT?

No documents? Didn't you just say you got a letter (NOA-1) extending your stay for one year, work and travel authorized?

Nebraska is currently processing applications filed January 9, so I'd say not to worry for at least a month.

And by the way ... typing in all caps on the internet is considered the same as walking into a room and screaming your conversation at the top of your lungs. Just so you know for next time.

1)The story is that we have filed the I-751 on January 23 via express mail ,so you can track you mail online and it arrived there on January 26,2006 .

In a week later, sometime in the beginnining of the February 2006 i ;ve received a Notice of Action Receipt with the date of January,26,2006,where it states that my Conditional Card extended 1 year and work and travel authorized.

2) Then in a week after, i;ve received the yellow colour letter where they;ve asked to attach the Conditional Card to the botom of the letter and mail it to them.

So, thats basically it, as since i;ve sent the Conditional Card away on February,2006

there was no response from the INS.

3) By no documents i mean that ,i don;t have my Conditional Card with me anymore and

my Removing conditions hasn;t approved or anything yet...

4) We have sent a letter to them , this Monday with a question about my case,so we hope that they will respond to us and write something at least... UNSURE..

I'll end it here and hope to hear any interesting information from any of you guys. :)

Aren't you not supposed to write and ask about your status unless the date they're supposed to be processing is past the day of your application? As I said, the USCIS case status site says NSC is currently processing applications dated January 9, and you said yours is January 26 ...?

I've heard of it taking over a year (not recently) to approved the I-751 and people needing to go get a passport stamp, so I'd say you're being pretty impatient ... you have your NOA-1, so you have proof of your status.
