time to file I-751 for removing conditions

my 2nd marriage anniversary was in dec 07 and my conditional permanent residency expire in Aug 08.

should I wait for may 08 (90 days window?)

or I can file I-751 form to remove conditions now (feb 08) ?

What makes you think you can remove condition now?

Jun 28 2004 : Received at NSC

Oct 25 2004 : Transferred to CSC

Oct 29 2004 : Received at CSC

Nov 8 2004 : Received response from CSC that my file is being requested & review will be done

Nov 10 2004 : Email & online status Approved

Nov 15 2004 : NOA 2 in mail

Dec 16 2004 : NVC assigns case number

Dec 20 2004 : NVC sent DS 3032 to beneficiary, copy of DS 3032 & I-864 fee bill to petitioner

Jan 3 2005 : Petitioner received copy of DS 3032 and I-864 fee bill. Post-marked Dec 23rd.

Jan 11 2005 : Beneficiary received DS 3032 in Indonesia

Jan 31 2005 : Sent DS 3032 to NVC

Feb 8, 2005 : NVC received DS 3032

Feb 21, 2005 : IV fee generated

Feb 25, 2005 : Sent I-864 fee bill

Feb 28, 2005 : I-864 fee bill delivered to St Louis

Mar 3, 2005 : IV fee bill received

Mar 7, 2005 : Sent IV fee bill

Mar 9, 2005 : IV fee bill delivered to St Louis

Mar 28, 2005 : I-864 fee credited against case.

April 6, 2005 : Received I-864 package

April 7, 2005 : Immigrant Visa fee credited against case.

April 11, 2005 : DS 230 is generated

Aug 12, 2005 : I-864 & DS 230 received by NVC

Sep 14, 2005 : RFE on I-864

Nov 3, 2005 : Checklist response received at NVC

Nov 25, 2005 : Case completion

Dec 9, 2005 : Police Cert requested from the Netherlands

Jan 12 2006 : Interview success - Approved !!

Jan 19 2006 : Visa & brown envelope picked up

You have to file I-751 within 90 days of 2nd anniversary of green-card, not before. If before they will send it back to you.

Is now a US Citizen immigration completed Jan 12, 2012.

some immigration lawyer told me that I can apply for I-751 now as it's already 2 yr since I got married. I was confused because expiration date written on my conditional permanent resident card is Aug 08. so I think I should wait till may for 90 days window period to start eventhough my second marriage anniversary was in dec 07?

Check the guides here on VJ for clarification.

You apply within the 90 days prior to the expiration of your Green Card.

For example, mine expires March 30 2008, so I better get on it! :yes:

Naturalization

Feb 28/2011 - sent paperwork

Mar 3/11 - received text & email notification - they have it!

Mar 15/11 - text, email, and notice sent - biometrics booked

April 12/11 - biometrics done - I start studying

May - get the letter

June 27 - Interview and oath ceremony - same day

Lifting Conditions

Feb 5/08 - Sent paperwork by USPS - priority

Feb 14/08 - NOA issued

Feb 28/08 - Biometrics letter received for The Bronx Office - have to reschedule

Mar 22/08 - Biometrics rescheduled - LOVE the Saturday appointment!

Feb ?/09 - done!

You can apply 90 days before your GC expires... since it will expire on August 08, then you can start applying 90 days before Aug. 08. :yes:

06 March 2010 - received I-797C, Notice of Action/Receipt

01 April 2010 - Biometrics Appointment (Biometrics done 4/7/10)

27 April 2010 - received I-797C/ Request to Appear for Naturalization Interview

02 June 2010 - Interview schedule

17 June 2010 - Oath Taking (Memorial Auditorium, Sacramento, CA)

You are correct, 2nd wedding anniversary has nothing to do with when you can file I-751. Some people on CR-1 visas enter the USA just before their second wedding anniversary, and get a conditional card, so they are filing the I-751 just before their forth wedding anniversary.

The 90 day window is based on the conditional green-card expire date.

Only exception is if the couple is divorced, then the I-751 can be filed with waiver of joint filing requirement, anytime between when divorce is finalized, and expiration of the C-Green-Card.

Correct, case in point is this recent thread about another idiot lawyer saying it was OK to adjust status from a crewman's visa.
