Today was my interview and they issued a letter of 221 (g) denial

Today was my interview and they issued a paper of 221 (g) denial ,what is that mean and what must i do now??i m :crying::crying:

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

Section 221(g) which prohibts the issuance of a visa to anyone whose application does not comply with the provision of the immigration and nationality act or regulation issued pursuant thereto.

Your case has been returned for review to the approving immigraion office via the National vsa center you will be contacted and may follow up directly with that office for further information

My K3 petition was returned back to USCIS on Jan,22nd,2008 and i am still waiting till this moment to hear from the USCIS

Others: Just further note down the road, is this a typical response, well ok, I guess it can be, but dont they usually say exactly what it is they need, i.e,, proof of bonfide marriage, and correct me if wrong, when the approving immigration officer approves and sends off to embassy, they pretty much have all the paperwork areas covered? At the interview they are basically looking to see if what was submitted is actual fact and then also will ask for an assortment of paperwork such as bank accounts, joint assets, letters, whatever?????

Just was wondering since most of the denials on the 221(g) that i have seen posted here show some more information...but again, learning everyday.

6/09 tax transcript for 2007 just became available -whoot

6/20 NVC receives everything nothing more to give them now just close eyes and pray

6/23 NVC enters into system

6/26 NVC - RFE uggh - wants all three years of Federal tax return listed and they lost originals or so they say - DING DING ROUND TWO

7/25 NVC Case completed whooottttttttt

8/7 Case forward to US EMBASSY LONDON OH YEAHHHHHHHH -

Embassy - case out for delivery to embassy via DHL sneaky us lol

08/10Received

08/19 Medical Exam completed - healthy oh yeah!!!!!!!!

9/26 @8am -Interview - approved VISA IN HAND OMG WHOOT!!! HELLO AMERICA MY LUV

POE- Atlanta then MCO - October 15th with the cat "GIT" on board lol - POE SUPER SWEET

Husband home finally - god what a journey....but after 400+ days we made it

Section 221 (g) also states the consular officer "should explain clearly to the applicant what documents or other evidence is needed, or what procedural steps need to be completed." Did the embassy give you a chance to do this?

Unfortunately, your file will probably go back to USCIS eventually, unless you can go back to the embassy and asked them what is needed. The good news is that federal regulations require that USCIS send a written notice of intent to deny and must provide all derogatory evidence it used in its decision. You'll have a chance to response. But you may need a lawyer if it goes this far.

they did not explain for me,but she told me this is step1 ,,,, step2 your application will be sent back to DHS

This section may quote this but you prob will never know the reason, how many here know the reason for returns? Also prob no intent to deny (maybe a few years down the line) maybe since ours was k1 it maybe different i dont know> but it was returned, i had my rep contact them to see what needed to be done or to get this denial/closure letter. There response was it is not denied but expired, so get your rep involved now. You may can even get it stopped and not returned just to convince them to keep and give you another chance to add more or whatever they may need but you have to work quickly to get them to hold it there. This was thru Calif and now has been (returned since June) Calif had no intent to let me know if rep had not asked, Vermont is now (touching) some that were returned 20 months ago and these people had never heard one work until they noticed their date changes.

one heart....i was also given a 221g letter...mine however was a little different...

Mine says : ''your case is pending mandatory administrative processing. It may take an average of 3 months. You will be contacted when it is completed."

The ladies on the MENA forum have told me that this is very common (actually happens MOST of the time) with Middle Eastern applicants. This does not mean that you are not approved--I think that even in your case it is stating the same: that additional review is necessary. Did they say whether or not the interview was successful??? They are really confusing in Amman about this. They told my husband that everything was fine and this was normal processing. If they didn't ask you for any other info...just be patient...if the NVC needs something else from you then they will contact you through mail and let you know what further information.

I am sorry, I know it is sad, but unfortunately this is how the MENA appointments go...we just wait.....PM me if you want to talk further about it...also the ladies on the MENA forum know alot more than I do...so you may want to PM one of the more experienced members there.

Some of these notices can be overcome with the intervention of a local attorney familiar with the Consulate. That is the course of action I would recomment.

Surely, you have some clue as to the reason. Usually, they don't believe the relationship is bona fide. So, why do you think this happened?

That's a straigh Notice of Intent to Deny. As I see it, you have two choices.

1. Get a local lawyer to attempt to intervene immediately.

2. Kiss the visa goodbye.

You must have some clue as to the reason for this, based on the interview. What do you think?
