Hello. I have a question about the Affidavit of Support process. I cannot provide the last two years of income (TAX RETURNS) b/c I was a postgraduate student and living off savings, which were depleted during this time. I just started a job a few weeks ago, and my mother has volunteered to be a joint applicant; however, her income the last two years went barely over the poverty line due to SSI, as her job was just something to keep her productive. Will I have a chance of being able to sponser my spouse with these factors?

Not at this time...as your mothers salary would have to be enough to support her family(however many people) and your fianceee. So if she's barely at the poverty level I don't think adding another member to the household size will look favorably on the numbers for the Affidavit of Support.

What stage of the process are you at now? If you're just now petitioning for the K-1 because of the backlog you have a few months to wait before they even approve the petition here. This is time for your to document your new job and earnings. You can use that evidence, provided it is above the poverty line for your household size (whatever that may be) on the Affidavit of Support.

Hello and thank you Paula for your reply. I have not started anything at this point. Trying to get a feel for what to do, and if a lawyer is necessary. So you mean that even though I have a VERY recent job, after a few months due to the backlog, this information will be enough? I won't get asked for the last two years of income? And would I just supply earning statements? Do you know where I could see the current income levels considered above the poverty line for this year? Sorry to bombard you, as you can see I am quite new to the process and feel overwhelmed.

11/08/2011 - Interview date THANKS GOD went smooth n pretty easy with the nice lady IO takes 9-10 minutes wow???????????????

I think I waited more time for my Oath Ceremony schedule rather than interview process and after 13 minutes the lady gave my sched WOW CAN'T BELIEVE ......yayyyyyyy

Hello to all. I forgot to ask if SSI is considered an eligible source of income, since it's not a handout from the government, but an accumulation of your earnings over the years? Like I mentioned in my opening post, I have just started working, but my mother has offered to be a co-sponser. Up until late September she had a job, plus was receiving SSI, now just SSI. I am working now and still a student but not full-time as before. Note that I've not appeared on my mothers' taxes as a dependent since MANY years now. We do live in the same home, however. Do I have a chance in my case?

Btw, I saw the poverty guidelines for 2007, and was wondering what the starting amount and the 125% figures actually mean. Does it mean that if one makes at least the poverty guideline starting amount for your family size it's acceptable, or do I need to make as much as the 125% mark....or somewhere in between the two?
