I made the big mistake on going over on the VWP in November 2005. I married in January 2006 and did apply AOS within the 90 day period. Overall i stayed there for approx 120-130 days then came back to the UK as the marriage was a big mistake. I now would like to go back to visit the states but dont know if i can on the VWP. Does anyone know how i go about finding out if i can travel? I was thinking of writing a letter to the US embassy in London. Not sure if anyone knows whats the best to do here. I dont want to take the chance of travelling all the way there and getting turned away with a ban.

If you have overstayed you are no longer eligible for the VWP and you may have a ban in place.

Also, if you did not withdraw your petiton for AOS you could have problems with that as well. Happened to the lady in front of us at the airport on one of our visits.

I withdrew my AOS in writing at the Vermont Centre in summer 2006. I have heard through the grape vine that as i AOS within my 90 days my VWP will be ok. Whether thats true or not i dont know. I would like to find out for sure if i can travel or not.
