Not engaged before married

Hi VJs

I hope this is the right section to classify my concern.. Basically I consulted a lawyer for our petition and upon reviewing my letter of how we met and when we intend to get married etc. my lawyer amended the letter by inserting 'we recently got engaged' but we are not officially engaged that states it on paper or anything else. Will the USCIS want to see evidence of our engagement? We are not engaged we just want to get married! Am I worrying for nothing? I'm sure the lawyer knows what he's doing but thought I'd ask you guys first. I've left him a message to contact me back so any responses would be great.

There is no "Official Engagement" All you need to provide USCIS, and later the embassy is a signed letter from both persons that they intend to marry within the 90 days of the K-1 visa.

See the example letter of intent in the example forms.

Engaged officially means "pledged to be married; betrothed: an engaged couple" according to dictionary.com :) There does not have to be some official engagment, just mutual agreement that you want to marry... hence the point of a K1 visa. Perhaps the lawyer stated that in the letter so that USCIS doesnt mess up the application, and so they clearly know you intend to marry on the I-129

4. Involved in conflict or battle.

5. Being in gear; meshed.

6. Partly embedded in, built into, or attached to another part, as columns on a wall.

I think that by definition you are, or claim to be, engaged. You have pledged yourselves to each other and in fact you will sign a letter of intent during the visa process. The USCIS and NVC and Embassy are all looking for this pledge to each other or intent. Getting engaged can be as simple as "Will you marry me" and the answer being "Yes". Proof of intent can be shown with the letters of intent or the receipt for an engagement ring. There are other proofs as well. But I think it is safe to assume that you are indeed engaged, unless your intent is something other than getting married.

Engagement means intent, mutual intent. It is redundant to filing a k-1. You both have agreed to get married which is the condition of applying for the k-1. At the interview they may ask the intent -- which better be marriage. If you say it, it is good enough. You are engaged.

May 7, 2007 -- I-129F K1 sent to NSC

Dec 26, 2007 -- K1 Visa approved.

Sep 16, 2008 -- AOS/EAD/AP sent to Chicago

Apr 01, 2009 -- Conditional green card arrives.

Feb 19, 2011 -- Mailed I-751 Packet to lift conditions

Nov 11, 2011 -- Permanent GC rev'd in mail.

Apr 25, 2012 -- Mailed N-400 Naturalization

Aug 16, 2012 -- Citizenship Interview. Approved.

Sep 06, 2012 -- Citizenship Oath.

The relevant requirement for a K-1 is that there is intent to marry within 90 days of entering the US. There is no requirement for any kind of formal engagement. There was really no reason for your lawyer to insert the phrase, although it doesn't hurt either.
